Document David Carson, as Parent and Next Friend of O. C., et al., Petitioners v. A. Pender Makin, 20-1088, Motion to extend the time to file a, Main Document (U.S. Mar. 26, 2021)
March 26, 2021 Scott Harris, Clerk Supreme Court of the United States Office of the Clerk 1 First Street, NE Washington, DC 20543-0001 Re: David Carson, et al. v. A. Fender Makin, No. 20—1088 Dear Mr. Harris: I am writing to request a thirty-day enlargement of the deadline by which Respondent must respond to Petitioners’ Petition for Writ of Certiorari.
On March 22, 2021, the Court requested a response to the Petition by April 21, 2021.
Due to the press of other business, undersigned counsel anticipates that she will need additional time to prepare a response to the Petition.
Accordingly, Respondent requests that the deadline to respond to the Petition be enlarged until May 21, 2021.
I contacted Michael Eugene Bindas, counsel for the Petitioners, regarding this request, and he responded that I may represent that Petitioners do not oppose the request.

Brief amicus curiae of Foundation for - Main Document

Document David Carson, as Parent and Next Friend of O. C., et al., Petitioners v. A. Pender Makin, 20-1088, Brief amicus curiae of Foundation for, Main Document (U.S. Mar. 11, 2021)
The First Circuit Court of Appeals erred in concluding that Trinity Lutheran Church v. Comer and Espinoza v. Montana Department of Revenue do not control the outcome of this case.
The "pervasively sectarian" approach unfairly discriminates in favor of secular schools, fosters excessive entanglement of government with religion, and is increasingly disfavored by the courts.
"Among religions in this country which do not teach what would generally be considered a belief in the existence of God are Buddhism, Taoism, Ethical Culture, Secular Humanism and others.” Torcaso v. Watkins, 367 U.S. 488, 496 n.11 (1967) (citations omitted).
The well-established Oxford English Dictionary defines religion first as “The belief in and worship of a superhuman controlling power, especially a personal God or gods.” However, it renders two other definitions to help the reader comprehend the full meaning of the word.
It is time to make “equal access” mean exactly what it says and to stop sending a message of exclusion to religious persons as though they were a suspect class of second-class citizens who are not fully part of the community.

Document David Carson, as Parent and Next Friend of O. C., et al., Petitioners v. A. Pender Makin, 20-1088, Brief amici curiae of States of Arkansas, Main Document (U.S. Mar. 11, 2021)
Amici are the States of Arkansas, Alabama, Ari- zona, Georgia, Kansas, Kentucky, Louisiana, Missis- sippi, Missouri, Montana, Nebraska, Ohio, Oklahoma, South Carolina, Tennessee, Texas, Utah, and West Virginia.
In 19th-century New England, “the basic governmental unit responsible for providing education was the town.” John Maddaus & Denise A. Mirochnik, Town Tuitioning in Maine: Parental Choice of Secondary Schools in Rural Communities, 8 J. Rsch.
Statements that Chapter 693 made no substan- tive changes only make sense against the background of the 1980 attorney-general opinion that interpreted prior Maine law to exclude religious schools, even without a textual basis for that exclusion.
of Non-Public Educ., U.S. Dep’t of Educ., Education Options in the States 1 (2009) (defining “scholarship” or “voucher” pro- grams).15 But the First Circuit’s abbreviated Estab- lishment Clause analysis made no mention of the fact that the town-tuitioning program also allows parents the freedom to direct tuition funds as they see fit.
Thus the Second Circuit ordered the dis- trict court “to amend its preliminary injunction to pro- hibit the appellees from continuing to deny the appel- lants’ requests for tuition reimbursement under the [program], regardless of the appellants’ chosen school’s religious affiliation or activities.” Id. at 1-2.

Students with special physical or intellectual challenges, vic- tims of bullying, children of active-duty military, reli- gious minorities, girls or boys who do best in a single- sex learning environment—all benefit from the multi- tude of options created by school choice.
His parents reached the point of exasperation until they discovered that the Nevada Opportunity Scholarship program made possible a dif- ferent choice: a school where, his mom says, “[t]hey en- courage patience, kindness, and that every child is im- portant.
My grades were as low as my motivation, and there didn’t seem to be any signs of change.” Then Walter’s mom applied for an EdChoice Ohio scholar- ship so he could attend Tree of Life Christian School, where he thrived, taking part in sports, music and drama, and student council.
It works according to the research: “Evidence from around the world suggests that studying within ‘dis- tinctive educational communities in which pupils and teachers share a common ethos’ vastly increases the odds of students’ acquiring academic and civic knowledge, skills, and sensibilities.” Id.
