Although I am not required to do so, United States v. Sealed Defendant 1, 49 F.4th 690, 697 (2d Cir. 2022) (“While district courts must ‘give the parties reasonable notice that it is contemplating ... a departure,’ Fed. R. Crim.
P. 32(h) (emphasis added), this requirement does not extend to variances”), the parties should be aware that I am considering an upward variance with regard to the sentencing of Defendant Calvin Darden, Jr. (“Darden, Jr.” or “Defendant”).
In addition, please provide any other information produced in discovery that suggests that Darden, Jr. may have deceived Charles Briscoe as to the nature of the Dream scheme.
Specifically, on page 7 it states “We also anticipate the Government’s argument that Calvin Darden, Jr. was well aware of the possible harm to his family due to his conduct for which he was convicted.
d. Did the Broker have a contract for the sale of the Ridgewood Road House prior to the exchange of text messages produced by the Government attached to its sentencing submission?

The terms of Mr. Gilder’s supervised release included—in addition to the standard terms— the following obligations: 1) completion of 100 hours of community service, 2) participation in an approved outpatient mental health treatment, 3) taking required medication, 4) certain financial prohibitions, and 5) restitution and forfeiture.
Undersigned counsel spoke to Mr. Gilder’s Probation Officer Samantha Walker 1 Following the Court’s oral pronouncement of its sentence during the hearing, Mr. Gilder immediately began complying with its terms.
He has completed a year of supervised release in full compliance with all terms and has already satisfied his community service, restitution, and forfeiture obligations.
Mr. Gilder has maintained a steady residence and family life since his arrest and through his time under supervision, and he is a devoted son, husband, and father.
In short, Mr. Gilder does not pose a risk of reoffending or a danger to the public, and his experience with the criminal justice system in the present case has only strengthened his respect for the law and his desire to give back to his community.
