MARY KAY VYSKOCIL, United States District Judge: On October 18, 2022, Chris Recamier (“Defendant”) was sentenced principally to a term of imprisonment of 108 months following his plea of guilty to charges relating to major fraud against the United States, in violation of 18 U.S.C. § 1031.
The Defendant’s sentencing guidelines range was 108 to 120 months’ imprisonment, based on an offense level of 31 and a criminal history category of I.
Part B, as relevant here, amends Guidelines § 4C1.1, by providing a 2-level offense level reduction for offenders with zero (0) criminal history points who meet specified eligibility criteria.
Defendants whose requests are granted by the courts can be released from prison no earlier than February 1, 2024.
The United States Probation Office has issued a report indicating that the Defendant is eligible for a sentence reduction under Amendment 821.

No. 146 PRELIMINARY ORDER OF FORFEITURE AS TO SPECIFIC PROPERTY/MONEY JUDGMENT as to Adedayo Ilori

As a result of the offenses charged in Counts Two through Four and Six of the Indictment, to which the Defendant was found guilty following a jury trial, all of the Defendant’s right, title and interest in the Specific Property is hereby forfeited to the United States for disposition in accordance with the law, subject to the provisions of Title 21, United States Code, Section 853.
The published notice of forfeiture shall state that the petition (i) shall be for a hearing to adjudicate the validity of the petitioner’s alleged interest in the Specific Property, (ii) shall be signed by the petitioner under penalty of perjury, and (iii) shall set forth the nature and extent of the petitioner’s right, title or interest in the Specific Property, the time and circumstances of the petitioner’s acquisition of the right, title and interest in the Specific Property, any additional facts supporting the petitioner’s claim, and the relief sought, pursuant to Title 21, United States Code, Section 853(n).
Pursuant to 32.2 (b)(6)(A) of the Federal Rules of Criminal Procedure, the Government shall send notice to any person who reasonably appears to be a potential claimant with standing to contest the forfeiture in the ancillary proceeding.
All Specific Property forfeited to the United States under a Final Order of Forfeiture shall be applied towards the satisfaction of the Money Judgment.
Pursuant to Rule 32.2(b)(3) of the Federal Rules of Criminal Procedure, the United States Attorney’s Office is authorized to conduct any discovery needed to identify, locate or dispose of forfeitable property, including depositions, interrogatories, requests for production of documents and the issuance of subpoenas.

While serving the term of imprisonment, the Defendant shall make installment payments toward his restitution obligation, and may do so through the Bureau of Prisons’ (BOP) Inmate Financial Responsibility Plan (IFRP).
BOP staff shall help the Defendant develop a financial plan and shall monitor the inmate’s progress in meeting his restitution obligation.
If the Defendant defaults on the payment schedule set forth above, the Government may pursue other remedies to enforce the judgment.
Additional Provisions The Defendant shall notify, within 30 days, the Clerk of Court, the United States Probation Office (during any period of probation or supervised release), and the United States Attorney’s Office, 86 Chambers Street, 3rd Floor, New York, New York 10007 (Attn: Financial Litigation Unit) of (1) any change of the Defendant’s name, residence, or mailing address or (2) any material change in the Defendant’s financial resources that affects the Defendant’s ability to pay restitution in accordance with 18 U.S.C. § 3664(k).
Subject to the time limitations in the preceding sentence, in the event of the death of the Defendant, the Defendant’s estate will be held responsible for any unpaid balance of the restitution amount, and any lien filed pursuant to 18 U.S.C. § 3613(c) shall continue until the estate receives a written release of that liability.

Accordingly, the sentencing of Mr. Ilori is ADJOURNED from October 6, 2023 at 11:00 AM to October 23, 2023 at 11:00 AM.

MARY KAY VYSKOCIL, United States District Judge: The Court is in receipt of letters from both parties regarding the sentencing of Defendant Adedayo Ilori.
There is no need to schedule a separate Fatico hearing, as Defendant will have ample opportunity to discuss these issues at sentencing.
The Government requests that this Court set a sentencing date.
The sentencing of Defendant Ilori is scheduled for October 6, 2023 at 11:00

Defendant requested three weeks to review the trial record, exhibits, and related materials.
On or before July 10, 2023, Defendant is directed to file a formal letter clearly stating whether he is requesting a Fatico hearing and, if so, explaining the issues he seeks to address and providing legal authority.
Any response by the Government should be filed on or before July 17, 2023.
