On November 16, 2023, the Court heard oral argument on Amazon.com, Inc., Amazon Web Services, Inc., and Twitch Interactive, Inc.’s (collectively, “Amazon”) Motion for Further Supplemental Fees (the “Motion”).

Mr. McCormick stated that PersonalWeb “wants to continue discussions to potentially reach a mutually agreeable dollar amount following this filing.” Id. ¶ 17.
Based on the representations in the McCormick Declaration, it appears that the parties would benefit from additional time to discuss resolution of the issue of a potential stipulated reduction in Amazon’s request for attorneys’ fees related to work performed in pursuit of an alter ego theory.
Accordingly, the Court hereby ORDERS that the deadlines for both (1) the parties’ filing of a stipulated fee reduction and (2) Amazon’s response to PersonalWeb’s supplemental opposition are extended to December 1, 2023.

(collectively, “Amazon”) (collectively, PersonalWeb and Amazon may be referred to as “Parties”) of infringing, inter alia, U.S. Patent Nos. 7,802,310 and 6,928,442; WHEREAS, on May 23, 2023, Amazon filed a request for further supplemental fees (including for fees pursuant to 35 U.S.C. § 285; the appeal fees denied without prejudice by the Court in its April 19, 2021 Order (Dkt. 656); and fees that Amazon has incurred since) (“Fees Submission”) (Dkt. 880); WHEREAS, the Court has scheduled the Fees Submission for a hearing on October 5, 2023; WHEREAS, PersonalWeb desires additional time to oppose the Fees Submission, and Amazon does not object to giving PersonalWeb such additional time; WHEREAS, Amazon desires additional time to file its reply in support of its Fees Submission, and PersonalWeb does not object to giving Amazon such additional time; NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED amongst the Parties that that the deadline for PersonalWeb to file any opposition to Amazon’s Fees Submission before this Court be extended from June 6, 2023 until July 14, 2023; and the deadline for Amazon to file any reply in support of its Fees Submission before this Court be extended from June 13, 2023 until September 15, 2023.

On May 19, 2023, a motion in support of further supplemental fees request was filed.
The Court STRIKES the motion for noncompliance with the Court’s Standing Order Re Civil Cases.
First, a motion for fees may be no more than ten pages.
And third, all motions’ for attorneys’ fees must include a chart in the format set forth in the Standing Order.
A corrected motion in support of further supplemental fees SHALL be filed by May 26, 2023.

On May 5, 2023, three declarations were filed in support of the further supplemental fees request of Amazon.com, Inc., Amazon Web Services, Inc., and Twitch Interactive, Inc. ECF Nos. 873, 874, 875.
There does not appear to be any underlying fee motion in support of which these declarations were filed.
The ECF entries state that the declarations are “in Support of [853] Order on Stipulation,” but that is a Scheduling Order.
Defendants SHALL file a motion for further supplemental fees if they would like these declarations to be considered.

No. 862 Order on 860 Joint Discovery Submission

Before the Court is the Parties’ Joint Discovery Submission regarding an alleged waiver of privilege by third party investors (“Investors”) who have previously appeared in this action.
The Investors raise an argument of attorney work product, suggesting that “Disclosure of the materials to Gersh was not the equivalent of disclosure to PW itself.” The Court is not so certain.
Amazon argues subject matter waiver because an Investor produced “other emails with Mr. Gersh and ‘other PersonalWeb representatives’ concerning the loan transactions ... .
” If Amazon seeks to pursue this argument, it must specifically identify exemplar emails including the “other PersonalWeb representatives” that purportedly lead to waiver.
This request is DENIED for the reasons previously stated when the subject documents were identified on the record as being transferred from the SAM law firm to the Investors and is not to be addressed in the supplemental briefing.

The Court is in receipt of the status report prepared by the Stubbs, Alderton law firm (“SAM”) (Dkt. 843) pursuant to this Court’s orders (Dkts.
704, 793, 799, 803, 816, 826, 836, 842.1 In navigating this process, the Court has carefully weighed the generally broad scope of post-judgment discovery, the third-party status, albeit with ties to PersonalWeb, of the above-referenced custodians, and the proportionality requirements of Rule 26.
With regards to SAM, production is further complicated by issues of privilege held by persons or entities other than PersonalWeb which have not been waived.
Amazon also complains that SAM has “artfully worded” the status report to justify withholding otherwise responsive documents, such as holding back work product unless it was shared specifically with a PersonalWeb “director, officer or employee.” Id. Amazon asks this Court to order that the 18,000 responsive but withheld documents be formally logged with sufficient information to justify withholding.
The Court returns to balancing on one hand the broad scope of post-judgment discovery2 and the well-developed record before it as to the relationships between PersonalWeb, the subpoenaed parties and SAM.
