On November 16, 2023, the Court heard oral argument on Amazon.com, Inc., Amazon Web Services, Inc., and Twitch Interactive, Inc.’s (collectively, “Amazon”) Motion for Further Supplemental Fees (the “Motion”).

Mr. McCormick stated that PersonalWeb “wants to continue discussions to potentially reach a mutually agreeable dollar amount following this filing.” Id. ¶ 17.
Based on the representations in the McCormick Declaration, it appears that the parties would benefit from additional time to discuss resolution of the issue of a potential stipulated reduction in Amazon’s request for attorneys’ fees related to work performed in pursuit of an alter ego theory.
Accordingly, the Court hereby ORDERS that the deadlines for both (1) the parties’ filing of a stipulated fee reduction and (2) Amazon’s response to PersonalWeb’s supplemental opposition are extended to December 1, 2023.

FENWICK & WEST LLP WHEREAS, Plaintiff PersonalWeb Technologies, LLC (“PersonalWeb”) has accused Defendants Amazon.com, Inc., Amazon Web Services, Inc., and Twitch Interactive, Inc. (collectively, “Amazon”) (collectively, PersonalWeb and Amazon may be referred to as “Parties”) of infringing, inter alia, U.S. Patent Nos. 7,802,310 and 6,928,442; WHEREAS, on May 23, 2023, Amazon filed a request for further supplemental fees (including for fees pursuant to 35 U.S.C. § 285; the appeal fees denied without prejudice by the Court in its April 19, 2021 Order (Dkt. 656); and fees that Amazon has incurred since) (“Fees Submission”) (Dkt. 880); WHEREAS, the Court has scheduled the Fees Submission for a hearing on October 5, 2023; WHEREAS, PersonalWeb desires additional time to oppose the Fees Submission, and Amazon does not object to giving PersonalWeb such additional time; WHEREAS, Amazon desires additional time to file its reply in support of its Fees Submission, and PersonalWeb does not object to giving Amazon such additional time; NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED amongst the Parties that that the deadline for PersonalWeb to file any opposition to Amazon’s Fees Submission before this Court be extended from June 6, 2023 until July 14, 2023; and the deadline for Amazon to file any reply in support of its Fees Submission before this Court be extended from June 13, 2023 until September 15, 2023.

And third, all motions’ for attorneys’ fees must include a chart in the format set forth in the Standing Order.
A corrected motion in support of further supplemental fees SHALL be filed by May 26, 2023.

There does not appear to be any underlying fee motion in support of which these declarations were filed.
The ECF entries state that the declarations are “in Support of [853] Order on Stipulation,” but that is a Scheduling Order.
Defendants SHALL file a motion for further supplemental fees if they would like these declarations to be considered.
