DECISION + ORDER ON MOTION

Document BARBARA HOLMES v. CITY OF NEW YORK et al, 152095/2020, 14 (N.Y. Sup. Ct., New York County)
In this action seeking damages for personalinjuries stemming fromatrip and fall on the sidewalk abutting P.S. 198, located at 1700 Third Avenue,in the County, City and State of New York, co-defendants, NYC School Construction Authority and Whitestone Construction Corp., now move pursuant to CPLR 3212 for summary dismissal of the complaint and crossclaims.
The moving defendants “[m]ade a prima facie showing oftheir entitlement to judgment as a matter of law by submitting evidencethat they did not perform work connected to the defect at issue” (Amini v Arena Const.
Namely, the moving defendants demonstrate that their work at the premises did not encompass the sidewalk and that the alleged defective condition existed prior to their work at the premises.
As there is no opposition to the motion, the moving defendants’ showing is unrebutted.
Accordingly, it is hereby ORDEREDthat NYC School Construction Authority and Whitestone Construction Corp.’s motion pursuant to CPLR 3212 for summary dismissal of the complaint andall crossclaims is granted, and the compliant and crossclaims are dismissed; andit is further ORDEREDthat the moving defendants shall serve a copy of this decision and order upon all parties, with notice of entry, within fourteen (14) days.

In Motion Sequence #4, Defendant, Bell moved to dismiss the amended complaint which included the fraud and promissory estoppel causes of action.
The MS #4 Court Order denied the motion without prejudice, due to the unsworn declaration Bell submitted in support.
Order dated, February 22, 2021, on the groundthat that the Court had thoroughly examinedthe Plaintiffs causes of action and correctly decided to dismiss them.
