(“BANA”) that all claims and causes of action alleged against BANA in the above-captioned action are hereby dismissed with prejudice, with each side to bear its own costs and attorneys’ fees.
Nothing herein shall affect any claim of Plaintiffs against Defendant U.S. Bank National Association.

Consistent with Federal Rule of Civil Procedure 30(d), the parties may not extend depositions beyond one business day without prior leave of the Court.
No party may offer expert testimony – whether designated as “rebuttal” or otherwise – beyond the scope of the opinions that the aforesaid disclosures cover, except with leave of the Court, application for which must be made no later than 7 calendar days after the latter of the dates specified in paragraph (8).
Any party seeking to make a post-discovery dispositive motion shall submit a letter to the Court in accordance with Rule 4(A) of the Court’s Individual Practices by September 9, 2024.
Unless otherwise ordered by the Court, within 30 days from the date for the completion of Phase 2 discovery, or if any party has filed a motion for summary judgment at the conclusion of Phase 2 discovery, within 30 days from the Court’s decision on all summary judgment motions, the parties shall submit to the Court for its approval a joint pretrial order prepared in accordance with the Court’s Individual Practices and Federal Rule of Civil Procedure 26(a)(3).
At the close of Phase 2 expert discovery or after the resolution of post-Phase 2 summary judgment motions, the Court will set a Ready Trial Date.
