Scott v. Citizen Watch Company of America, Inc. et al, 5:17-cv-00436, No. 106 (N.D.Cal. Jan. 9, 2018)
Motion to File
On the other hand, compelling reasons exist to seal a limited number of quotations in the Expert Report of Steven Larry Londre (“Londre Report”), which was not attached to the Ryan Declaration or filed in a redacted and unredacted form in accordance with Civil L.R.
“Courts have refused to permit” public access to files that serve “as sources of business information that might harm a litigant’s competitive standing ... .” Nixon v. Warner Commc’ns, Inc., 435 U.S. 589, 598 (1978).
The public disclosure of this information would harm Bulova’s negotiating position in potential and current endorsements agreements with other third parties, who may demand additional funds based on Bulova’s previous arrangement with Buzz Aldrin.
Bulova keeps its budgets strictly confidential because they reveal Bulova’s business plan, operations, market pursuits, investments, and staffing levels.
Public disclosure of Bulova’s budget for Baselworld would harm Bulova because its competitors would have insight into Bulova’s business strategies for this important trade show.

Motion for Summary Judgment
When considering a motion for summary judgment, “[t]he moving party bears the burden of showing that there is no material factual dispute.
Therefore, the court must regard as true the opposing party's evidence, if supported by affidavits or other evidentiary material.” In re NCAA Student-Athlete Name & Likeness Licensing Litig., 37 F. Supp.
Under the common law right to privacy and publicity, use applies where Defendant’s actions constitute “the appropriation of plaintiff's name or likeness to defendant’s advantage, commercially or otherwise.” Maxwell v. Dolezal, 231 Cal.
For example, the language Bulova quotes from Maloney v. T3Media, Inc., 853 F.3d 1004 (9th Cir. 2017), pertains to the use of a person’s identity “in news reporting, commentary, entertainment, works of fiction or nonfiction, or in advertising that is incidental to such uses.” (MSJ at 10:26-11:1.)
Plaintiff has provided adequate evidence and/or legal argument to support all of the claims raised by Kay on summary judgment.
