SUPPLEMENTARY INFORMATION: The Commission instituted this investigation on December 7, 2011, based on a complaint filed by ChriMar Systems, Inc. d/b/a DMS Technologies of Farmington Hills, Michigan, alleging a violation of section 337 in the importation into the United States, the sale for importation and the sale within the United States after importation of certain communication equipment, components thereof, and products containing the same, including power over ethernet telephones, switches, wireless access points, routers and other devices used in LANS, and cameras.

The ALJ also determined that the “amendment will not prejudice the public interest or any of the rights of the parties in the investigation.” Id. No petitions for review of the ID were filed.

The Commission reverses the ALJ’s ID without prejudice to the parties’ right to move to amend the complaint and Notice of Investigation in a timely manner.

As a result of the merger, HP is the successor—in~interest to 3Com and agrees that, under Delaware law, it has fully assumed, inter alia, all property, obligations, debts, liabilities, duties “and all and every other interest” of 3Com.

Any party may move at any time prior to the issuance of an initial determination on violation of section 337 of the Tariff Act of 1930 for an order to terminate an investigation in whole or in part as to any or all respondents, on the basis of withdrawal of the complaint or certain allegations contained therein, or for good cause other than the grounds listed in paragraph (a)(2) of this section.

The presiding administrative law judge may grant the motion in an initial determination upon such terms and conditions as he deems proper.
