MCCARTHY, LLP [Proposed] Order Regarding Indirect Purchaser Plaintiffs’ Post-Distribution Accounting and Request for Release of Remaining Attorneys’ Fees; MDL No. 3:17-md-02801-JD; Case No. 3:14-cv-03264-JD This matter comes before the Court on the Indirect Purchaser Plaintiffs’ (“IPPs”) Notice of Post-Distribution Accounting and Request for Release of Remaining Attorneys’ Fees.
Having considered the Post-Distribution Accounting and IPPs’ Notice, the Court ORDERS:
The release of the remaining $1,934,375 in attorneys’ fees, plus proportional interest, previously requested by IPP Class Counsel and approved by this Court, which had been withheld pending further order of the Court, to be issued after counsel filed the Post-Distribution Accounting pursuant to the Northern District of California’s Procedural Guidance for Class Action Settlements.
IPPs shall provide a further update to the Court regarding any remaining Net Settlement Funds after the expiration of the September 2, 2023 void date on outstanding settlement checks to class members.

Durkin: The motion by certain restaurant DAPs to confirm that they have opted out of the Direct Purchaser Plaintiffs Class and are members of Track Two [6841] is granted in part and denied in part.
However, the Court denies the movants' request that they not be forced to participate in five settlements the Class has reached since the opt−out deadline with defendants Koch, Raeford, Simmons, OK Foods, and Mountaire.
The movants should have met the required deadlines and followed the procedures set forth in Rule 23 and the Court's orders for opting out of the class.
The movants are permitted late opt−out from the Class going forward, but they are bound by the settlements with defendants Koch, Raeford, Simmons, OK Foods, and Mountaire.
