Children's Health Defense v. Meta Platforms, Inc., et al, 21-16210 (9th Cir. Aug. 9, 2024)
We review the district court’s assessment of the adequacy of service for abuse of discretion, and we find none.
On its face, this system extended to truthful speech that the “whitelisted” Government officials nonetheless deemed to promote “Vaccine Discouragement.” It is also important to note that all of these actions took place against a backdrop ...
12 Of course, to the extent that CHD were to establish an ultimate entitlement to injunctive relief, Zuckerberg, the Poynter Institute, and others working in concert with Meta might nonetheless be incidentally covered by an injunction ...
C None of the additional contentions raised by the majority or by Defendants supports a contrary view with respect to the state-action issue.
That calls, as in Skinner, for a more tailored inquiry into whether, in light of those unique circumstances, state action is nonetheless present.

In re: Children's Health Defense Inc., et al, 22-2970, No. 40 (3rd Cir. Feb. 15, 2024)
The District Court granted Rutgers’ motion to dismiss, brought under Federal Rule of Civil Procedure 12(b)(6), concluding that none of the claims pleaded stated a viable cause of action.
Seeing none, we review the Policy for a rational basis and conclude that it satisfies this standard.
None of these options were ideal, and no doubt they created hardship for many.
... in Kovats: that the State of New Jersey has expressly granted Rutgers, a previously private institution, the authority to continue to function, in effect, as a private university with respect to its operations, with minimal limitations, none ...
But none of that explains the period of disparate treatment.

Joseph R. Biden, Jr., President of the United States, et al., Applicants v. Missouri, et al., 21A240, The applications for stay presented to (U.S. Jan. 13, 2022)
Nonetheless, even if I were to accept that Congress could have hidden vaccine-mandate power in statutory defini- tions, the language in these “health and safety” provisions does not suggest that Congress did so.
Here, in §1395x(e), none of the myriad subsections preceding the “health and safety” subsection suggests that the Government can order hospi- tals to require virtually all hospital personnel to be vac- cinated.
In these cases, the relevant agency did none of those things, and the Court rewards this extraordinary departure from ordinary principles of administrative procedure.
