Document Do No Harm v. Pfizer Inc., 23-0015, No. 225 (2d Cir. Jan. 10, 2025)
Do No Harm is a Virginia-based, nationwide membership organization whose stated mission is “to protect healthcare from radical, divisive, and discriminatory ideologies, including the recent rise in explicit racial discrimination in graduate and postgraduate medical programs.” Id. at 9.
It disputes the district court’s conclusion that associations like Do No Harm lack standing to sue on behalf of their members under § 1981, and it challenges the court’s assessment of the merits of its Title VI and ACA claims.
Consequently, to establish standing for a preliminary injunction, “a plaintiff cannot rest on such mere allegations as would be appropriate at the pleading stage but must set forth by affidavit or other evidence specific facts, which for purposes of the summary judgment motion will be taken to be true.” Id. (cleaned up).
Circuit subsequently endorsed the majority view from Klayman, holding that “an inability to establish a substantial likelihood of standing requires denial of the motion for preliminary injunction, not dismissal of the case.” Food & Water Watch, Inc. v. Vilsack, 808 F.3d 905, 913 (D.C. Cir. 2015).
In Murthy, the Supreme Court considered whether the individual and state plaintiffs had Article III standing to secure a preliminary injunction enjoining federal government officials from urging social media platforms to remove or suppress content.
