Granting Commission Investigative Staff's Unopposed Motion to Amend the Date for Its Initial Claim Construction Brief No. 644618

(May 8, 2018) On May 7, 2018, Commission Investigative Staff ("Staff") filed an unopposed motion ("Motion") seeking an extension of one week to file its initial claim construction brief, from May 18, 2018, to May 25, 2018.

For good cause shown, namely that "that it would be more productive and efficient to file [Staff's] initial claim construction brief after the private parties file their respective initial claim construction briefs," and because there is no opposition, Staff's Motion, Motion Docket No. 1093-007, is hereby granted.

Amended Ground Rules No. 643913

(May 2, 2018) Ground Rule 1.6 has been amended to include recent Commission policy with respect to the submission of documents that contain confidential business information ("CBI").

To provide advance notice of forthcoming public versions to all parties and the Court (and Office of Unfair Import Investigations ("OUII"), if applicable), the filing of a purportedly confidential motion or related document should contain highlighting of only that CBI material/information that complies with 19 C.F.R. § 201.6(a), consistent with Ground Rule 1.10.

In most cases, the redaction of only discrete words and phrases that are CBI is appropriate.

Ground Rule 1.10 has been amended to require proposed redactions of information subject to the protective order to be highlighted, for example in transparent yellow, rather than bracketed.

Ground Rule 11.1 also has been amended to require that citations to case law and evidence are included in the text of the motion/response/brief/document, and not in footnotes, with only rare exceptions permitted (e.g., a point of law that is an aside and not a main point).
