No. 294 MEMORANDUM ORDER regarding discovery disputes

Document Vitaworks IP, LLC et al v. Glanbia Nutritionals (NA), Inc., et al.,, 1:19-cv-02259, No. 294 (D.Del. Jul. 27, 2023)
The Court entered an Order assigning me to serve as a special master to hear and decide discovery disputes in this litigation.
It is my understanding that Plaintiffs have agreed to produce documents related to Dr. Song’s interactions with AoKe and Jiaao and his communications with other third parties concerning licensing Plaintiffs’ taurine-related patents.
Following receipt of the photographs and any inspection of the hard copies, should Defendants still require additional information, they should meet and confer with Plaintiffs and if necessary, reach out to me with any further disputes on this issue.
Plaintiffs allowed Defendants to look in the room, but they were not permitted to inspect the interior of a cabinet that appeared to contain a large bottle of white powder and several closed compartments.
Alternatively, the parties could meet and confer to find a potential compromise result whereby Plaintiffs produce a detailed inventory along with photographs of the contents of the room.

Document Vitaworks IP, LLC et al v. Glanbia Nutritionals (NA), Inc., et al.,, 1:19-cv-02259, No. 289 (D.Del. Jul. 13, 2023)
Motion to StayGranted
230 regarding the scope of Defendants' requested inspection of Vitaworks' facilities; and (iv) QYP' s Motion To Compel Compliance with, and Remedy Violation of, the Stipulated Protective Order (D.I.
As for the first factor, granting a stay pending the Court' s resolution of various disputes bearing on Vitaworks ' Court-ordered right to conduct a second inspection of QYP' s plant will simplify the issues for trial.
Indeed, QYP' s Emergency Motion seeks sanctions including "precluding Vitaworks' ability to shift the burden of infringement under 35 U.S.C. § 295."
Although fact discovery is set to close on July 14, 2023 , important factual issues remain outstanding, including Vitaworks' second inspection of QYP' s facility .
In addition to the Court's decision on Vitaworks' experts and QYP's Emergency Motion, other disputes impacting fact discovery remain pending, including two issues that have been referred to a Special Master (D.I.
