Motion to Extend Time to File Response
December 8, 2023 Re: Eric Passman, et al. v. Peloton Interactive, Inc., Case No. 19-cv-11711 (LJL) Joint Letter Requesting Entry of Stipulation to Extend Time
The Parties in the above action jointly write to respectfully request the Court enter the attached proposed Stipulation for Extension of Time in accordance with Practice 2.K of the Court’s Individual Practices in Civil Cases.
Given the intervening holiday season and the Parties’ previous agreement to extend Peloton’s deadline to file these motions, the Parties have met and conferred, and agreed to set an agreed upon briefing schedule, setting the deadline for Plaintiffs’ oppositions on or by January 12, 2024, and Defendant’s replies on or by January 31, 2024.
Therefore, the Parties respectfully request that the Court enter the attached Stipulation for Extension of Time, extending Plaintiffs’ oppositions to Defendant’s pending motions to January 12, 2024, and Defendant’s replies to January 31, 2024.

Here, the Honorable Alka Sagar, United States Magistrate Judge has scheduled an evidentiary hearing on the order to show cause why Ms. Inthavong’s bond should not be revoked and, further, has authorized the parties to conduct discovery.
(“Pretrial Services”) filed a Pretrial Violation Report informing the Court about three instances wherein the location monitoring device affixed to Ms. Inthavong broke.
(Id.) At that time, Pretrial Services recommended the Court hold a hearing at which Ms. Inthavong would be ordered to show cause why bond should not be revoked.
Therefore, I am asking that they be produced with early return so that all parties – the defense and the government – can timely review and prepare them for use either in written submissions or at an evidentiary hearing consistent with the deadlines outlined by the Court in its July 29 order.
On August 12, 2024, I contacted counsel for the government by email to inform them of my intention to file this Application to obtain authorization to issue an early return subpoena.

Ms. Agarwal intends to address two related issues at the evidentiary hearing: (1) her desire to keep her counsel of choice, McGuire Woods, and (2) her need for the improperly frozen funds to do so.
If we discover additional documents that we intend to show, we will immediately notify the government and the Court.
We anticipate that the direct examination of the three witnesses we intend to call--Ms. Agarwal, Ms. Bell, and Mr. Blegen--will take a total of ninety minutes to two hours.
