Its purported “application” of Tandon simply concluded that none of the exempted secular activities was comparable to face-to-face No. 20-2256 Resurrection Sch. et al. v. Hertel et al.
In any event, none of the panel majority’s second-order attempts to distinguish Resurrection School’s face-to-face instruction from the various secular activities MDHHS exempted can withstand analytical scrutiny.
As explained below, however, none of these proffered rationales can withstand serious scrutiny. never to recur.

Accordingly, it is ORDERED, that the previous decision and judgment of this court are vacated, the mandate is stayed and this case is restored to the docket as a pending appeal.
