Great American Insurance Co vs Virgin, PR-122234, No. 1058189647 (Okla. Jun. 4, 2024)
e Waived a jury trial; ¢ Waivedthe right to appeal; ° Waivedtherightto file dispositive motions or to challenge any benchtrial rulingsor the judgment“in any form orfashion,”including by post-trial motion or appeal; * * * Provided that Plaintiff would waive punitive damages--i.e., the componentof a potential recovery subject to constraints on insurance coverage; Provided that Dolese wouldpay Plaintiff at least $2 million but not more than $20 million depending onthe benchtrial judgment; and Provided that the trial court would be informed of the “high-low” agreement, but not the parametersof Plaintiff’s agreed recovery, except that “the amountsare within the available insurance coverage afforded to Dolese.” App.2,titled “High-Low Agreement.” Unlike Dolese’s treatment of GAIC, Dolese did inform Travelers (which hadissuedless than 13% ofthe total insurance) ofits subscription to the “High- Low Agreement,” and Travelers reportedly consentedtoit.
Delhi Gas Pipeline Corp. v. Swanson, 1974 OK 26, 520 P.2d 670 (prohibition granted wheretrial court improperly refused dismissal of trespass action asserting claim foreclosed by prior determination in separate proceeding).
Dolese’s bad faith claim wholly depends onthe same insurance coverage contract dispute asserted by both sides, and is a compulsory counterclaim for Dolesein the federal action under Fed.R.Civ.P.
The Court of Civil Appeals followed and applied Garcia’s holding in a workers’ compensation case, Soule v. Crane Logistics, 2016 OK CIV APP 25, 15-16, and 20, 370 P.3d 1224 (affirming denial of personal injury claimant’s post-judgmentattempt to implead additional parties as employers).
There, a homeowners’ association had sued property owners for violating deed restrictions, and whenit failed to prevail it was held liable for the owners’ attorney fees, so it moved tofile a third-party complaint against (apparently) its insurer, which the trial court granted.
