On September 12, 2022, this Court specially set oral argument on the pending Motion to Dismiss for October 17, 2022 at Western New England University School of Law.
As this Court stated in its order denying requests for amici participation in Baptiste, the First Circuit has cautioned that “a district court lacking joint consent of the parties should go slow in accepting ... an amicus brief.” Baptiste v. Kennealy, Case No. 1:20-cv-11335-MLW, Order denying motions to appear as Amici Curiae, [Dkt 79] (D.Mass. August 21, 2020) at 2, citing Strasser v. Doorley, 432 F.2d 567, 569 (1st Cir. 1970).
In Strasser, the First Circuit chided the district court for inviting “the filing of an amicus brief by a member of the bar who is nationally prominent in the civil liberties field.
Similarly, the Puerto Rico district court relied on Strasser to grant the government’s motion to bar advocacy groups from participating as amici in a criminal case.
Since there was no question that the parties were adequately represented and no indication of special interest or the need to supplement the parties’ presentations, the government’s motion to deny amicus participation was granted.

Now come the defendants in the above-captioned action and respectfully move this Court, pursuant to Local Rule 7.1(b)(3), for leave to file a brief reply in support of Defendants’ Motion to Dismiss.
Defendants request leave to file a reply not to exceed five pages (excluding caption, signature block, and certificate of service) to address several legal and factual arguments made in plaintiffs’ opposition to Defendants’ Motion to Dismiss, and to bring new authority to the Court’s attention.
Plaintiffs, through counsel, have assented to the allowance of the instant motion.
For the foregoing reasons, defendants request that instant motion be allowed.
