Pursuant to Federal Rule of Appellate Procedure 27, defendants-appellants the United States of America and the Centers for Medicare & Medicaid Services (CMS) respectfully move to hold this appeal in abeyance for 60 days.
This appeal concerns a challenge to a final rule issued by CMS in 2024 that, among other things, states that recipients of deferred action under the Deferred Action for Childhood Arrivals program are considered “lawfully present in the United States” for certain purposes under the Affordable Care Act (ACA) and consequently may be eligible to obtain health insurance on an ACA exchange and to receive certain federal subsidies.
The federal government appealed the district court’s Appellate Case: 24-3521 Page: 1 Date Filed: 02/11/2025 Entry ID: 5484863
Due to the recent change in administration on January 20, 2025, CMS and the U.S. Department of Health and Human Services (HHS) are now under new leadership.
As a result, the federal government respectfully suggests that this appeal be placed in abeyance for 60 days to allow HHS and CMS time to complete their evaluation.
