The so−called arsonist profile offered by this proposed witness is not genuinely based on specialized knowledge, nor would the opinion be helpful to the jury.
The Plaintiff's motion [314] to exclude Barry Feld is granted in part and denied in part: Feld may not opine on the Miranda legal framework (the Court will give an instruction to the jury), but he may opine that the Plaintiff possessed the cognitive ability to waive Miranda rights.
The Court notes that it had been inclined, at the pretrial conference, to remove the blistering and alligatoring evidence from the trial if the Defendants agree not to rely on it for probable cause.
The defense motion 316 to bar John Lentini is denied except insofar as he no longer needs to rebut Sandau and Rafailovich, who have been excluded.
Given these decisions, and also because the courtroom deputy received an email late last night stating that the County Defendants have settled with the Plaintiff, the Court proposes to hold opening statements tomorrow (05/09/2023).

As part of settlement efforts, however, the Court will email the Plaintiff and the City separate ex parte communications to make a point on the respective risks of litigation in an attempt to create additional settlement momentum.
Naturally, the lawyers for each side shall show the settlement communication from the Court to their client.
