Dear Counsel: The amicus curiae brief of the Iowa Chapter of American Academy of Pediatrics and American Academy of Pediatrics has been filed.
Please note that Federal Rule of Appellate Procedure 29(g) provides that an amicus may only present oral argument by leave of court.
Please note that if permission to present oral argument is granted, the court's usual practice is that the time granted to the amicus will be deducted from the time allotted to the party the amicus supports.

No. 20 MOTION by American Academy of Pediatrics, and the South Carolina Chapter of the American Academy ...

Document Disability Rights South Carolina v. Henry McMaster, 21-2070, No. 20 (4th Cir. Oct. 1, 2021)
Courts consider whether “the proffered information of amicus is timely, useful, or otherwise necessary to the administration of justice.” Id.; see also Prairie Rivers Network v. Dynegy Midw.
Generation, LLC, 976 F.3d 761, 763 (7th Cir. 2020) (Scudder, J., in chambers) (“[T]he court looks at whether the submission will assist the judges by presenting ideas, arguments, theories, insights, facts, or data that are not found in the briefs of the parties.” (internal quotation omitted)).
The attached brief reflects the American Academy of Pediatrics’ (“AAP”) constant work over the past 18 months to understand how to treat and reduce the spread of COVID-19, as well as how to provide safe education that fosters children’s development despite the pandemic.
It provides the findings of AAP’s comprehensive review of the medical literature, along with the collective experiences of the vast majority of practicing pediatricians in the United States.
For these reasons, several district courts hearing similar matters have granted motions of the AAP and state chapters of the AAP for leave to file as amici curiae to provide the courts information on the AAP’s recommendations and the importance and efficacy of maintaining universal mask policies in schools.
