Defendant eBay Inc. (“eBay”) hereby moves, unopposed and pursuantto LocalRule 7.2, for leaveto file under sealits forthcoming Motion to CompelPlaintiffs’ Initial Disclosures, along with its supporting Memorandum of Law and exhibits.
As groundsfor this motion, eBaystates as follows: iF eBay andPlaintiffs have an ongoing dispute concerningPlaintiffs’ Initial Disclosures, SupplementalInitial Disclosures, and Second SupplementalInitial Disclosures (together, the “Disclosures”), which eBay contendslack several important categories of information required by Rule 26(a)(1).
eBay intendsto file a motion to compelPlaintiffs to supplementtheir Disclosures to provide the categories of information and documents sought by eBay.
eBay’s motionwill attach and necessarily discuss the substanceof Plaintiffs’ Disclosures.

The motions seek to modify protective orders entered in an entirely separate proceeding, which is not permissible under any circumstances, including where the same judge happens to preside over both matters.
Furthermore, the motions fail because Plaintiffs have no compelling reason for modifying the protective orders in the criminal action when the materials at issue can be sought from eBay in discovery here.
First, as a threshold matter, Plaintiffs’ motions are procedurally defective because they seek to modify the terms of protective orders entered in an entirely separate criminal proceeding, and under no circumstances is that proper.
Second, Plaintiffs offer no compelling justification to modify the protective orders, which expressly prohibit the use of discovery materials produced in the criminal case outside that proceeding.
Indeed, the fact that Plaintiffs have an alternative means of seeking these materials—a document request to eBay—underscores the absence of a compelling reason to modify the protective orders in the criminal action.

The Government did not take a position on plaintiffs’ motion concerning materials eBay, Inc. produced to defendants Baugh and Harville in the Criminal Case in response to the Fed. R. Crim.
However, materials obtained through the grand jury, FBI 302s, and evidence obtained from sources other than eBay should remain subject to the protective order in the criminal case and should not be produced in discovery in the civil matter.” Harville would need to review a substantive discovery request propounded by the plaintiffs in accordance with Fed. R. Civ.
P. 34 to determine whether responding would comport with the abovementioned caveats raised by the Government as to both he Protective Order in the Criminal Case and in this civil action.
In addition, the Motions for Relief risk circumventing the threshold proportionality analysis applied to pretrial discovery.
For the reasons set forth above, defendant Harville respectfully requests that this Honorable Court deny the Motions for Relief.
