Opinion

Document Abdelmuti v. El Centro Regional Medical Center, D081505, Opinion (Cal. Ct. App., 4th Dist. Apr. 24, 2024)
2 1 Abdelmuti as an hourly, nonexempt phlebotomist from approximately June 2020 to April 2021, at Center’s El Centro location.
) It did so in the context of reviewing a judgment on an order sustaining a demurrer without leave to amend in favor of the defendant city on a class action alleging the city paid plaintiffs— nonexempt hourly employees—less than the legally ...
... unlike the defendant in Marquez, the Regents was not a charter city or any type of entity listed in Wage Order No. 4-2001, and the plaintiff did not include allegations in her complaint that the Regents set the hourly rate for any nonexempt ...
) None of these cases compel us to reject Abdelmuti’s allegations that Center failed to pay minimum wages for hours worked.

Opinion

Document Garcia-Brower et al. v. ALCO HARVESTING LLC et al.,, B327137, Opinion (Cal. Ct. App., 2nd Dist. Nov. 22, 2023)
The trial court consolidated the cases for all purposes at the request of the Labor Commissioner.2 Alco moved to compel arbitration of Guzman’s claims pursuant to a written agreement he and other workers signed in Mexico during their orientation.
It noted Alco had not listed mandatory arbitration as one of the material terms of employment when it sought DOL certification to hire Guzman and other temporary workers under the H-2A program.
Orders so posted are called “Clearance Orders.” Employers must try to recruit from the domestic labor market and hire any “qualified, eligible U.S. worker who applies ... until 50 percent of the period of the work contract has elapsed.” (Id., § 655.135(c), (d).)
The Job Orders submitted to DOL have lengthy addenda describing such things as work experience and physical requirements, the grounds for terminating a worker, training and production standards, and reimbursement of transportation costs.
California Rural Legal Assistance, Inc., Corrie L. Meals, Sandra Aguila, Ana Vicente de Castro, and Dennise Silva; Dawson Morton for Plaintiff and Respondent Jesus Guzman.

Opinion

Document In Re Uber Technologies Wage and Hour Cases, A166355, Opinion (Cal. Ct. App., 1st Dist. Sep. 28, 2023)
Uber’s and Lyft’s motions did not seek to compel arbitration of the People’s and the Labor Commissioner’s requests for civil penalties and injunctive relief, but they nonetheless asked the court to stay those portions of the actions ...
And none of the above theories supports compelling their claims to arbitration.
) As we have discussed, none of these cases holds that public law enforcement officials must arbitrate their statutory claims when they have not agreed to do so and have no preexisting relationship with the parties to the arbitration ...
