`Upon entry of the foregoing amendment, Figures 1-10 have been replaced with replacement
`
`Figures 1-10. Replacement Figures 1—10 are identical to original Figures 1-10, but with the band
`
`disclaimed. No new matter has been added. The Appendix has been canceled and amendments
`
`have been madeto the specification to reflect these changes. The specification is also amended as
`
`requested by the Office.
`
`Based on the above amendmentand the following remarks, Applicant respectfully requests
`
`that the Office reconsiderall outstanding objections and rejections and that they be withdrawn.
`
`Objection to the Specification
`
`The Office objects to the specification. The specification has been amendedfor form as
`
`requested by the office. Applicant requests that the objection to the specification be withdrawn.
`
`Rejection under 35 U.S.C. § 102
`
`The claim is rejected under 35 U.S.C. §102 as allegedly being unpatentable over D745,421
`
`to AKANAef al. (US Application No. 29/501,746). This application claims priority under § 120 to
`
`US Application No. 29/501,746, among others, which wasfiled September 8, 2014. US Patent No.
`
`D745,421 is prior art only as ofits issue date, December 15, 2015. Therefore, it is not priorart to
`
`this application. Even if it were priorart as ofits filing date, September 8, 2014, that would still not
`
`be prior to the effective filing date of this application. Therefore, 745,421 is not priorart to this
`
`application and the rejection under 35 U.S.C. § 102 should be withdrawn.
`
`Conclusion
`
`All of the stated grounds of objection and rejection have been properly traversed,
`
`accommodated, or rendered moot. Applicant therefore respectfully requests that the Examiner
`
`reconsiderall presently outstanding objections and rejections and that they be withdrawn. Applicant
`
`believes that a full and complete reply has been made to the outstanding Office Action and, as such,
`
`the present application is in condition for allowance. If the Examinerbelieves, for any reason, that
`
`personal communication will expedite prosecution of this application, the Examineris invited to
`
`telephone the undersigned at the number provided.
