`managementprofile including permitted data usage during a service plan cycle by the child

`wireless end-user device;

`evaluating a current data usage by the child wireless end-user device during the service

`plan cycle against the permitted data usage by the child wireless end-user device during the

`service plan cycle, to determine a match status between the permitted data usage and the current
`
`data usage; and
`
`in response to determining the matchstatus, restricting data usage by the child wireless
`
`end-user device during the service plan cycle.

`the parent wireless end-user device execute a commonoperating system type.

`REMARKS
`
`The Non-Final Office Action, dated March 21, 2024 (hereinafter “Office Action’),
`
`rejected claim 1. By the present amendment and response, Applicant cancels claim 1, and adds
`
`new claims 2-21. Thus, after the present amendment, claims 2-21 remain pending in the present
`
`application. Applicant respectfully requests allowance of claims 2-21 in view of the following
`
`remarks.
`
`
`
`A. 35 U.S.C.§101
`
`The Office Action rejected independent claim 1, under 35 U.S.C. § 101, as being directed
`
`to a judicial exception.
`
`Without acquiescing to the propriety of the rejection of independent claim 1 by the Office
`
`Action, in order to expedite the prosecution of the present application, Applicant has cancelled
`
`independent claim 1, and submitted new claims 2-21. Therefore, Applicant respectfully submits
`
`that the rejection of independent claim 1, under 35 U.S.C. § 101, is rendered moot.
`

`
`B. 35 U.S.C.§103
`
`The Office Action rejected independent claim 1, under 35 U.S.C. § 103, as being
`
`unpatentable over Burnett (U.S. Publication No. 2009/0068984) (hereinafter ““Burnett’”) in view
`
`of Baker (U.S. Publication No. 2015/0222759) (hereinafter “Baker’).
`
`Without acquiescing to the propriety of the rejection of independent claim 1 by the Office
`
`Action, in order to expedite the prosecution of the present application, Applicant has cancelled
`
`independent claim 1, and submitted new claims 2-21. Therefore, Applicant respectfully submits
`
`that the rejection of independent claim 1, under 35 U.S.C. § 103, is rendered moot.

`By the present amendment, Applicant has added new independent claim 2, which recites
`
`“A method for use by a child wireless end-user device being subject to control by a parent
`
`wireless end-user device,” where the method includes:
`
`receiving, via a wireless modem of the child wireless end-user
`device, a management profile created for the child wireless end-user
`device by the parent wireless end-user device, the management profile
`including permitted data usage during a service plan cycle by the child
`wireless end-user device;
`
`evaluating a current data usage by the child wireless end-user
`device during the service plan cycle against the permitted data usage by
`the child wireless end-user device during the service plan cycle,
`to
`determine a match status between the permitted data usage and the current
`data usage; and
`
`in response to determining the match status, restricting data usage
`by the child wireless end-user device during the service plan cycle.
`
`Applicant respectfully submits that the cited art of record fails to disclose,
`
`teach, or
`
`suggest the limitations of new independent claim 2. New independent claim 12 has limitations
`
`similar to those of new independent claim 2. As such, new independent claims 2 and 12, and
`
`their respective dependent claims 3-11 and 13-21, should be allowed.
