`DECISION ON
`RENEWEDPETITION
`' UNDER 37 CFR 1.137(a)
`
`This decision is in response to applicant’s “RENEWED PETITION UNDER37 CFR 1.137
`(a),” filed on 23 October 2023.
`
`BACKGROUND
`
`In a decision from this Office on 23 August 2023, the petition filed on 16 June 2022 was
`dismissed. The decision stated that the petition under 37 CRF 1.137(a) was filed more than
`two years after the date of abandonmentof this application. Therefore, additional
`information that provides an explanation of the circumstances surrounding the delay that
`establishes the entire delay was unintentional was required. The decision further states, p
`etitioner must explain whythis initial petition wasnotfiled until 16 June 2022.
`
`On 23 October 2023, petitioner filed the current renewedpetition.
`
`DISCUSSION
`
`Asset forth in 37 CFR 1.137(b), a petition under 37 CFR 1.137(a) requesting that an
`application be revived on the groundsof unintentional abandonment must be accompanied
`by: (1) the required reply unless previously filed, (2) the petition fee as set forth in 37 CFR
`1.17(m), (3) any terminal disclaimer required under 37 CFR 1.137(d), and (4) a statementthat
`the entire delay in filing the required reply from the due date for the reply until the filing of a
`grantable petition under 37 CFR 1.137 wasunintentional.
`
`The petition to revive the abandonedapplication under 37 CFR 1.137(a) was filed more than
`two years after the date of abandonment. Petitioner has submitted the required statement of
`unintentional delay. The renewedpetition satisfies item 37 CFR 1.137(b)(4).
`
`
`
`In the renewed petition, petitioner filed a supplemental explanation adequately explaining the
`circumstances surrounding the delay and establishing the entire delay was unintentional.
`
`Consequently, the renewedpetition is deemed to satisfy requirement(4) under 37 CFR 1.137
`(a). As a result, all of the requirements set forth in 37 CFR 1.137(a) have beensatisfied.
`
`DECISION
`
`For the reasons above, the petition under 37 CFR 1.137(a) is GRANTED.
`
`This application is being forwarded to the National Stage Processing Division of the Office
`of PCT Operationsfor further processing in accordance with this decision.
