`valve plate lower surface facing the fixed scroll is spaced apart from the fixed scroll, and the
`
`valve plate further includes a protruding portion protruding from the valve plate lower surface
`
`toward the fixed scroll and through which the outflow port is formed’.
`
`According to amended Claim 21, since the valve plate (730) is spaced apart from the
`
`fixed scroll (500), the valve plate (730) further includes the protruding portion (732) protruding
`
`from the valve plate lower surface (730b) toward the fixed scroll (500) and through which the
`
`outflow port (736) is formed. Therefore, the discharge valve (600)is interposed between the
`
`fixed scroll (500) and the valve plate lower surface (730b) andthe refrigerant discharged from
`
`the discharge opening (512) flowsinto the discharge chamber (D). See Figs. 3 and 14 of the
`
`present patent application included hereinbelow for convenience.

`Thus, the cited references, alone or in combination, do not disclose, teach, or suggest the

`limitations of Claim 21. Therefore, Claim 21 is allowable. It follows that Claims 23-29, 31-32,

`and 35-40 which depend from Claim 21 are also allowable.

`Allowable Claim 30 is amendedto includethe limitations of base Claim 21 and

`intervening Claim 23, thereby rewriting Claim 30 into independent form. Thus, Claim 30 is

`allowable.
