`Dependent claims 2 to 11 and 13 to 15 do not contain any features which, in
`combination with the features of any claim to which they refer, meet the
`requirements of the PCT in respect of novelty and/or inventive step (Article
`33(2) PCT and Article 33(3) PCT).
`
`The additional feature of claim 2 is known from D2. The inclusion of a step of
`discounting measurements discounting from the expected relationship (par.
`161) into the method of D1 would be an obvious matter in order to improve the
`accuracy ofthe fitting process.
`
`The additional features of claims 3 to 5, 11 and 13 to 15 are disclosed in D1 as
`D1 shows a method where the expected relationship includes zero asymmetry
`for a certain bias value (par. 81-83, fig. 7), the measurements comprising
`measurements at locations with several positive and negative bias values (par.
`89,90, fig. 9), associated with a continuous variation of bias across a target
`region (par. 103,104) and wherein the performance parameter is overlay (par.
`87-104, fig. 9,10) and the bias variation is a variation of positional offset
`between featuresin twodifferent layers (par. 73, fig. 4).
`
`The additional features of claims 6 and 7 are known from D3. The inclusion of a
`step of obtaining asymmetry measurements from two sub-targets with equal
`and opposite bias variation (par. 70,71, fig. 12), where the fit of the
`measurementsto the expected relationship is combined to determine the
`performance parameter (par. 72-77, fig. 13) into the method of D1 would be an
`obvious matter in order to increase the accuracy of the performance parameter
`determination.
`
`The additional features of claims 8 to 10 are disclosed in D4. The inclusion of
`an anchor point defined by a feature of the target (col. 8, lines 23-42, fig. 3)
`comprising a variation of the measured asymmetryresulting in changesof the
`slope of a bias variation (col. 8, line 23 - col. 9, line 45, fig. 3,3A) into the
`method of D1 would be an obvious design matter in order to increase the
`accuracy of the performance parameter determination.
