`I. INTRODUCTION
`
`On August 15, 2023, with the Board’s authorization, Petitioner and
`
`Patent Owner(collectively “the Parties”) filed a Joint Motion to Dismiss and
`
`Terminate this Proceeding. Paper 25 (“Joint Motion’).
`
`Il. DISCUSSION
`
`In the Joint Motion, the Parties represent that Petitioner “seeks to
`
`reallocate its budgets and resources,” and “[nJeither party wishes to spend
`
`additional resources on this proceeding.” Joint Motion 3. The Parties also
`
`represent that they “have no other dispute, and dismissal will resolve
`
`matters.” /d. at 2. “The parties further confirm that, beyond theirjoint
`
`agreementto file this motion, there are no other agreements between them,
`
`written or otherwise.” /d. at 4.
`
`Under 35 U.S.C. §317(a), an interpartes review “shall be terminated
`
`with respect to any petitioner upon the joint request ofthe petitioner andthe
`
`patent owner, unless the Office has decided the merits ofthe proceeding.” In
`
`view of the early stage ofthe trial in this proceeding, and given wehave not
`
`yet decided the merits, we determine that good cause exists to dismiss the
`
`petition and terminate this proceeding with respectto the Parties.
`
`This Order doesnot constitute a final written decision pursuant to 35
`
`U.S.C. §318(a).
`
`II. ORDER
`
`Accordingly, for the reasons discussed above,it 1s:
`
`ORDEREDthat the Joint Motionis granted, and the petition in
`
`IPR2022-01500 is dismissed andthis proceeding1s terminated.
