`
`Claims 13—19
`
`The invention as in claims 13-19 of the present
`
`application does not
`
`involve an inventive step in the
`
`light of documents 1—4 cited in the ISR.
`
`Document
`
`1 describes a strain of E. coli that was
`
`transfected with a gene coding for NoKAS I or NoKAS II
`
`(SEQ ID NO: 60) originating Nannochloropsis oculata, and
`
`a method for producing a lipid using said E. coli.
`
`Document
`
`1 further states the following:
`
`that the term
`
`lipids includes fatty acids and alcohols that are derived
`
`from lipids;
`
`that higher alcohol derivatives that are
`
`obtained by reducing higher fatty acids can be utilized
`
`as surfactants;
`
`that KAS I is mainly involved in
`
`elongation to Cm palmitoyl~ACP, and KAS II is mainly
`
`involved in elongation to Cm stearoyl—ACP; and that
`
`microalgae can be utilized as a host
`
`(paragraphs [0003],
`
`[0015],
`
`[0042],
`
`[0052]; comparative example 2).
`
`Furthermore,
`
`the amino acid sequence of SEQ ID NO:
`
`60
`
`described in document
`
`I has 89% identity with the amino
`
`acid sequence of SEQ ID NO:
`
`1 of the present application,
`
`and 97% identity with the amino acid sequence of SEQ ID
`
`NO:
`
`96 of the present application.
`
`In this case, document
`
`1 does not describe the use
`
`of the fatty acid acyl—CoA reductases specified in (G)
`
`to
`
`(R) of claim 13 of the present application.
`
`However, document
`
`1 states that higher alcohols
`
`obtained by reducing higher fatty acids are useful as
`
`surfactants, etc. Furthermore, as described in documents
`
`2—4
`
`(document 2:
`
`table II, etc., document 3: figure 4,
`
`etc., document 4: figure 4, etc.), it is known that

`
`alcohols can be produced by reducing fatty acids with a
`
`reductase such as FARl
`
`from Arabidopsis thaliana.
`
`Therefore,
`
`a person skilled in the art could have easily
`
`conceived of using a known reductase such as FAR1 from
`
`Arabidopsis thaliana to obtain a useful higher alcohol
`
`in
`
`the invention described in document 1.
`
`Furthermore,
`
`the invention of claims 13-19 of the
`
`present application cannot be considered to exhibit a
`
`particularly prominent advantageous effect that could not
`
`be predicted when compared with the inventions as
`
`understood from the descriptions in documents 1—4.
`
`As a result, a person skilled in the art could have
`
`easily accomplished the invention of claims 13-19 of the
`
`present application based on the invention described in
`
`document
`
`1 and the technical matters described in
`
`documents 2—4.
`
`Claims 1—12
`
`The invention as in claims 1-12 is novel and
`
`involves an inventive step in relation to documents 1—4
`
`cited in the ISR.
`
`Documents 1—4 describe the subject matter discussed
`
`above.
`
`However, none of documents 1~4 indicates that a
`
`long—chain fatty acid alcohol comprising a fatty acid
`
`alcohol of at least 20 carbon atoms can be produced using
`
`a microorganism transfected with a gene that codes for
`
`the B—keto acyl~ACP synthases identified in (A)
`
`to (F) of
`
`claim 1 of the present application, and such a matter
`
`cannot be considered obvious to a person skilled in the
`
`art.
