`REJECTIONS UNDER 35 U.S.C. § 103
`
`Claims 1—20 were rejected under 35 U.S.C. § 103 as unpatentable over Evans; Nicholas
`
`George et al. (US 20140213301 A1), hereafter “Evans,” in view of SAKARGAYAN, Anupam
`
`(US 20100315236 A1), hereafter “SAKARGAYAN.
`
`Claims 7—8 and 15 were rejected under 35 U.S.C. § 103 as unpatentable over Evans in
`
`view of SAKARGAYAN as applied to claims 6 and 14 above, and further in view of
`
`Krishnamurthi, Govindaraj an et al. (US 20060258371 A1), hereafter “Krishnamurthi.
`
`Claim 1 as amended recites:
`
`A tracking device comprising:
`1.
`a user interface for receiving an input from a user,
`a transmitter configured to transmit a configuration instruction to a mobile device in
`response to the user interface receiving the input from the user, the configuration
`instruction instructing the mobile device to emit a first sound,
`a receiver configured to receive, from the mobile device, a response to the configuration
`instruction indicating that the configuration instruction was received by the
`mobile device,
`a speaker configuration to emit sound, and
`a controller configured to, in response to receiving the response to the configuration
`instruction that indicates that the mobile device received the configuration
`instruction, cause the speaker to emit a second sound.
`
`The Office Action cites [0067] of Evans in the rejection of the claimed “controller”.
`
`Office Action, pages 5-6. In particular, the Office Action notes that this passage of Evans
`
`teaches:
`
`The user interface may also include local tracking options 606. Local tracking options
`606 may include causing the tracking device to play a sound, or may include a local
`tracking option for using the proximity sensor of the mobile device 500 and tracking
`device 106 to search for and locate the tracking device 106. Other local tracking options
`
`
`
`606, including a selection of various views or preferences, may also be displayed. In the
`illustrated example, the user 103 may select "play sound" to cause a tracking device 10 6
`to emit a sound
`). Office Action, page 6.
`
`Without agreeing to this characterization of Evans, Applicants note that “local tracking
`
`options [that] may include a local tracking option for using the proximity sensor of the mobile
`
`device and tracking device to search for and locate the tracking device” and “a selection of
`
`various views or preferences [such as] the user [that] may select “play sound” to cause a tracking
`
`device to emit a sound” is not equivalent to causing a tracking device speaker to emit a second
`
`sound “in response to receiving [a] response to [a] configuration instruction that indicates that
`
`the mobile device received the configuration instruction [transmitted by the tracking device
`
`transmitter” as claimed.
`
`In other words, Evans does not teach or suggest a tracking device that emits sound in
`
`response to receiving a confirmation that a mobile device received an instruction transmitted by
`
`the tracking device. The remaining references do not remedy this deficiency, nor does the Office
`
`Action so assert. Thus, claim 1 and all similar and dependent claims are patentable over the
`
`combination for at least these reasons, and the withdrawal of these rejections is respectfully
`
`requested.
`
`CONCLUSION
`
`Based on the foregoing, the application is in condition for allowance of all claims, and a
`
`Notice of Allowance is respectfully requested. If the examiner believes for any reason direct
`
`contact would help advance the prosecution of this case to allowance, the examiner is
`
