`Claims 1-4, 6, 10-15, 17, 18 and 20 are pending and under examination following entry
`
`of this amendment. Claims5, 8, 9 and 19 have been cancelled without prejudice. Claims 1 and
`
`14 have been amended. Support may be foundin the claims asoriginally filed and in the
`
`summary of the invention. No new matter has been added. All amendments and cancellation of
`
`claims are made without acquiescing to any of the Examiner's arguments or rejections, and solely
`
`for the purpose of expediting the patent application process and without waivingthe right to
`
`prosecute the cancelled claims (or similar claims) in the future. The issues and rejections
`
`identified in the office action are addressed in order below.
`
`Claims 1-6, 8-15 and 17-20 are rejected under 35 USC 103(a) as being obvious overthe
`
`combination of Sampalis, US 4133077, Fricke et al., and US Pat. Publ. 2006/0177486.
`
`Applicants respectfully submit that the claim amendments address the rejection. In particular,
`
`there is no teaching or suggestion in the combined references that a krill oil containing the
`
`specified levels of total phospholipids, ether phospholipids, triglycerides and astaxanthin esters
`
`can be obtained from a krill meal that has been stored from 1 to 36 months as claimed.
`
`Moreover, as detailed in the specification, the ability to obtain a krill oil from the stored krill
`
`meal that does not degradation products is an unexpected result and provides commercial
`
`efficiencies that could not have been predicted from the priorart.
`
`In summary, Applicant respectfully submits that there is no primafacie case of
`
`obviousness because the cited references do not provide each element of the claims and because
`
`the high quality krill oil obtained from the process is unexpectedresult.
`
