AMENDMENT AND RESPONSE UNDER37 C.F.R. § 1.111
`Serial Number: 13/247,241
`Filing Date: September 28, 2011
`Title: Re-issue of U.S. Patent No. 7,670,495
`
`Page 5
`Dkt: 3406.005USR
`
`REMARKS
`
`This Amendmentis submitted in response to the Office Action dated March 25, 2014.
`
`Claims 1, 55-59, 66, 70, 74, 80, 81 and 85 are pending. All other claims have been cancelled.
`
`The PTOhasstated that the claims presented above would be allowable if all formal
`
`requirements are complied with. Applicant submits that the foregoing claims comply with this
`
`requirement pursuant to 37 CFR 1.173. Applicant has indicated the numberof times each claim
`
`has been amendedrelative to its original presentation. Applicant has bracketed subject matter
`
`that is to be deleted from the pending claims (see claim 59) and has underlined new amended
`
`subject matter, if any (none).
`
`Applicantreserves the right to submit a continuation reissue application to address the
`
`PTO concernsin regard to the system and suspension claims cancelled by this amendment.
`
`TextofClaim1
`
`The undersigned attorney states that claim 1 as presented in the foregoing claims repeats
`
`the correct text of claim 1 allowed in the PTO action of March 6, 2013. This action addressed
`
`the preliminary amendment of September 28, 2013 in which amended claims and new claims
`
`were presented. Becauseoriginal claim 1 was not amended, the text of original claim 1 was not
`
`recited in this preliminary amendment. In the subsequent amendmentofJuly 8, 2013, the text of
`
`claim 1 was included. However, the text of claim | from sister patent, U.S. 7,396,441 was
`
`inadvertently and incorrectly copied as the text of claim 1 for this reissue application instead of
`
`the text of original allowed claim 1. This mistake is corrected in this amendment. The text of
`
`original claim 1 of U.S. 7,670,495 is now presented as an allowed claim ofthis reissue
`
`application.
`
`The undersigned attorney called Examiner Allen on May 12, 2014 to inform Examiner
`
`Allen of the mistake and the correction. The undersigned attorney apologizes for the mistake
`
`and states that the text of claim 1 allowed by Examiner Allen is now presentedin this
`
`amendment.
`
`Applicant and Assignee submit that this reissue application is now in condition for
`
`allowance. A favorable action upon reconsideration is respectfully requested.
