`the parties filed a copy of a settlement (Ex. 2001) agreementalong with a joint

`request to treat the settlement agreementas business confidential, to be separate
`
`from the patent file. Paper 10. Theparties filed also a joint motionto terminate
`the proceeding pursuant to 35 U.S.C. § 317. Paper 9.

`This caseis in the preliminary proceeding’ stage; noinstitution of a trial has
`
`been made. Basedonthefactsof this case, it is appropriate to enter judgment.”

`Therefore, the joint motion to terminate the proceeding is GRANTED.
