`On February 5, 2015, the parties filed a Joint Motion to Terminate
`
`(Paper 13) pursuant to 35 U.S.C. § 317(a). In addition, pursuant to 35
`
`U.S.C. § 317(b) and 37 C.F.R. § 42.74(c), Patent Ownerfiled a copy of a
`
`Settlement Agreement (Ex. 1011), along with a Joint Request to Treat
`
`Settlement Agreement as Business Confidential Information (Paper 12).
`Thistrial is in its very early stages. No oral hearing has occurred in
`
`this case, and we have not madea final decision on the merits. The co-
`
`pending district court lawsuit between the parties was dismissed with
`
`prejudice, effective January 26, 2015, and the parties represent that they _
`
`havesettled their dispute. Paper 13, 2-4. Underthese circumstances, we
`determinethatit is appropriate to terminate the case without rendering a
`final written decision. 37 C.F.R. § 42.72. Based on the facts ofthis case,it
`is appropriate to enter judgment.’ Therefore, the Joint Motion to Terminate
`is granted.

`Accordingly,it is hereby:
`
`ORDEREDthatthe parties’ request that the Settlement Agreement be
`treated as business confidential information, to be kept separate from the
`patentfile, is granted;
`FURTHER ORDEREDthatthe Joint Motion to Terminate is granted;
`
`and
`
`FURTHER ORDEREDthat the proceedingis terminated.
`

`of a proceeding. 37 C.F.R. § 42.2.
