`Action received in the APPLICATION from the US. Patent and Trademark Office.

`6) I understand that a Published US. Patent Application No. 20020175468 was

`cited against claims in the APPLICATION as prior art (U.8. Application Serial No.

`10/300,359, filed 18 March 2002. That published US Patent application shall be referred
`
`to by me herein as the Kenny ‘468 Application.

`7) The Kenny ‘468 application makes the following priority claim:

`8) I have looked at the text of the Kenny Application and with guidance from
`
`outside Patent Law Counsel, Mark A. Litman, have considered the disclosure in the US.
`
`Provisional Applications in the priority claim of the Kenny Application.
`
`9) The Kenny ‘468 Application claims priority from two separate Provisional
`
`Applications.
`
`10) The relevant section of the Kenny ‘468 application is reproduced below:

`It is my understanding from the above quotation is that the ‘468 application
`
`is able to claim priority from earlier filed provisional applications only if the earlier
`
`applications contained the essential disclosure necessary to support the claims.
`
`I have
`
`reviewed the text of the two provisional applications and believe that there is no priority
`
`‘ in either Provisional Application for specifically a five—card player hand dealt against a
`
`six-card dealer hand.
`
`12) It is believed that the ‘468 application filed on 18 March 2002 was the first
`
`filing of Kenny that provided antecedent basis for the use of a S-card player hand in
`
`combination with a six-card dealer hand.
`
`12) As I understand the law (with advice from Patent Law Counsel) and by my
`reading of the disclosure of the earlier Provisional Kenny Applications and the later filed
`
`‘468 application, I see that the first Provisional Application filed on March 19, 2001 (the
`
`‘01 8 provisional) does not contain any disclosure of the dealer’s initial hand receiving
`
`more cards than the player’s initial hand (e.g., it does not contain disclosure of a 6-card
`
`dealer hand versus a player’s 5-card hand). Also, while the second application (the ‘503
`
`provisional), with the priority date of August 23, 2001 contains disclosure of the use of 6
`
`cards (besides 4 or 5 initial cards), there is again no specific reference or disclosure to the
`
`dealer’s initial hand receiving more cards (e.g., 6-cards) than the player’s initial hand
`
`(e.g., 5-cards) when the hands are played against each other. The only statement found in
`
`the later filed Provisional Application is on Page 7, stating:
`
`THIS IS ONE ANALYSIS OF PLAY FOUR POKER, BUT NOT THE
`EXCLUSIVE WAY. POSSIBLE OTHER BETS AND OTHER PAYOFF
`SCHEDULES WILL FOLLOW DEPENDENT ON WHETHER THE GAME IS

`AND DEALER, AND THEY PLAY WITH JUST THOSE FOUR (4) CARDS.

`13) My review of the above language clearly indicates to me that the ‘503
`
`Provisional Application never specifically indicated that the dealer has more cards than
`
`the player or that the dealer has six cards while the player has five cards.
`
`14) I personally recollect, and that recollection is supported by documentary
`
`evidence, that I had both conceived of and reduced to practice the play of a casino table
`
`poker game (at the time referred to internally as “Quad Poker,” indicating that it was a
`
`four-card poker hand) at least as early as May or June of 2001 , well before the available
`
`reference date of 23 August 2001 of the Kenny ‘503 Provisional Patent Application.
`
`15) That game, as I recollect it was played as follows, with the description taken
`
`from the text of an patent application filed in my name:
`
`“A casino table card game is played on a table by at least one player
`and a dealer. The dealer usually represents the house or the casino in the play
`of the game. As shown in Figure 1, wagering areas 10 are provided for each
`player, and card receiving areas 12 are available for each of the players and the
`dealer. The wagering area may include three distinct wagering zones for each
`player comprising a Bonus wager area 14 (e.g., the Aces-Up wager), an Ante
`area 16, and a Bet area 18. To initiate play of the game, at least one (and
`usually only one) deck of standardor variant playing cards is provided.
`In other
`forms of the game, multiple intermixed decks of cards, decks with wild cards or
`special decks (i.e. decks with certain cards removed) are used. Each player who
`wishes to enter the play of the game makes at least one wager selected from the
`Bonus Bet (or Aces-Up bet) and the Ante. One or both of these wagers may be
`made. The player may also play the hand blind (also referred to as the “House
`Way”) by placing both an Ante and an additional Game Bet (referred to in
`Figure l as the “Play Bet”). After placement of the at least one wager, gala
`player who has made an at least one wager is provided with a number of cards,
`preferably five, from which to select a best four-card poker hand. The cards
`may be dealt as a complete set of five cards or in portions of one or more cards.
`At about the Same time, the dealer is dealt a number of cards exceeding four. In
`one example of the invention, six cards are dealt. One or more additional cards
`can be dealt to the player, the dealer or both.

`“Although in one example of the invention the dealer receives one
`more card than each player, the number of cards dealt can be equal. What is
`important is that enough cards are dealt so that at least one discard can be made.
`“In a preferred form of the invention, a four card poker hand is played.
`The player reviews the five cards received at that player position and
`determines what best four-card poker hand can be made from the five cards. If
`the player believes that the cards cannot form a four-card poker rank of
`' sufficiently high rank to warrant competition against the dealer’s hand (even
`without that hand or any portion of that hand having been displayed), the player
`may fold the hand, refusing to place an additional wager. At this time or
`usually a later time, the Ante would be collected by the dealer. In one example
`of the invention, if the player made the Aces—Up bet and the Ante bet and
`decides to fold, the Aces-Up bet is swept along with the Ante. In another form
`of the invention, if the player remains in the game by making the Play Bet and
`the player’s hand does not contain a hand ranking of a pair of Aces or higher,
`and a bet was made on the Ace-Up wager, that wager may be now or later
`collected by the dealer. If the player determines that the rank of the best four-
`card poker hand that can be made from the five cards dealt to the player is
`sufficiently high as to warrant competition against the dealer (or if the player
`wants to ‘blufi’ against the dealer, particularly if the dealer must qualify), the
`player makes an additional wager, referred to as a play bet or game bet. That
`additional wager may be multiples of the Ante, such as 1X, 2X, 3X, 4X or 5X
`the amount of the original Ante, at the option of the player. In some examples
`of the invention, the game bet is 1X the ante unless the player has a qualifying
`hand such as a pair of kings or better for example. If the player’s hand qualifies
`he has the option of increasing his bet. Fractional amounts or larger amounts
`may be allowed, but they can complicate the payout or alter the hold for the
`house, so those changes are in the discretion of the casino. After discarding
`excess cards and placing the Game Bet, or placing the fifth card face down, or
`merely leaving the fifth card in the hand so that the hand may be arranged and
`ranked by the dealer or player when exposed, the player’s hand is placed on the
`table for display. The dealer’s hand is then revealed after each and every player
`has determined whether or not the Game Bet is to be made. The-dealer
`compares the value or rank of his hand against the value or rank of each
`player’s hand, usually in succession around the table, and each series of wagers
`(the Aces-Up wager, the Ante and the Game Bet) is resolved. Ties on the rank
`of player’s hands and dealers hands may be either paid to the player, called a
`push, or collected by the dealer, depending upon the desired house advantage
`the casino wants to build into the game. The dealer may either always qualify
`(a preferred method of play), or a level of qualification may be built into the
`game (such as at least Queen high, at least King high, at least Queen-Jack, At
`least King-Jack, at least Ace-King, or at least one pair).”

`16) After reducing the game to practice by defining the specific rules of play, I
`
`provided the rules of play to WKB Associates, Inc. in Reno, Nevada. The purpose of the
`
`submission of the rules was to have them evaluate the statistical events in the play of the
`
`game to determine casino hold and statistical outcomes. This is an essential step in
`
`evaluating the likelihood of success of a game, at least from the casino’s standpoint of
`
`determining how much money the casinos would statistically retain on the game.
`
`17) To confirm the fact that the complete knowledge of the game as described
`to me was in my possession at a time earlier than August 23, 2001, I attached herewith a
`
`copy of an Invoice sent to me at Shuffle Master, Inc., by WKB Associates, Inc. regarding
`
`the analysis of the “Quad Poker” game.
`
`I have redacted the dates from the invoice. The ‘
`
`invoice represents charges for work completed by WKB associates.
`
`18) I hereby declare and state that the date of the invoice showing completion of
`the analysis of Quad Poker Was substantively earlier than 23 August 2001.
`
`19) I hereby confirm and state that the different dates of the “DESCRIPTION”
`
`indicated on the Invoice for “Write program to Analyze ‘Quads’ version of poker” and
`
`“Write report, phone with R. Snow” were both earlier than the invoice date, which was
`
`itself substantively earlier than 23 August 2001.
`
`20) Also attached hereto is a copy of an authorization letter for a “Novelty
`Search for QUAD POKER” sent by Shuffle Master, Inc. to its outside Patent Counsel
`
`with a date that is earlier then the dates of the Invoice to WKB Associates, which are in
`turn earlier then the 23 August 2001 available reference date in the ‘503 Provisional
`
`Application filed 23 August 2001 used to establish priority for the concept of more
`
`dealer’s cards (e.g., a 6-card hand) than in the player’s hand (e.g., a S-card hand) to play a
`
`player-versus-dealer game of 4-card poker games. Although the date of the letter was
`
`redacted, I confirm that it was earlier than the redacted date on the Invoice and earlier
`
`than 23 August 2001.

`21) The authorization letter of paragraph 16) specifically describes the game of
`
`QUAD POKER therein as including steps of:
`
`a) “ n order to play the game, the player makes an optional player
`wager. He receives five cards, and uses these cards to make his best four card
`poker hand. In TCP [note, Three Card Poker® game] and CSP {note, Caribbean
`Stud® poker], players receive a hand of three or five cards, and all cards are used
`to play the game.”
`b) “The dealer then receives 6 cards. He makes his best four card
`hand. If the player hand beats the dealer hand, the player wins even more money
`on both the ante and play bet.”
`
`22) I believe that the documentary information in the form of the Invoice from
`
`WKB Associates, Inc. and the letter of authorization provide confirmation of my
`
`reduction to practice of the game described above as Quad Poker, and that the dates on
`
`the Invoice establish that this reduction to practice was earlier than 23, August 2001.
`
`23) Based upon the documentary evidence in the form of the Invoice from
`WKB Associates, Inc., the letter of authorization from Shuffle Master, Inc. and my I
`
`specific recollection of the game, as subsequently filed on in the United States Patent
`
`Office with the description provided above, I know that I invented the subject matter
`described above with regard to the play of Quad Poker earlier than 23 August 200I.
`
`24) Also attached to the Declaration is an e-mail request for instructions to
`
`proceed with the file of an Application on Quad Four Poker. The date of this e—mail
`
`correspondence and the attachments thereto, is even earlier than the earliest priority date
`
`in the Kenney stream of US. Patent Applications, namely Provisional Application No.
`
`60/277,018, filed March 19, 2001. Even though that earliest application was
`
`shown above to lack antecedent basis for the disclosure of greater numbers of
`
`cards (and specifically six cards) in adealer's hand versus a lesser number of
`
`cards (and specifically five cards) in a player's hand, this set of documents (e-
`

`25) Based upon the documentary evidence in the form of the two rules sheets
`and the e—mail correspondence forwarding those Rules Sheets requesting instructions by
`the Shuffle Master, Inc. inventor (myself, Roger Snow) and my specific recollection of
`
`the game, as described in the e-mail attachments), I know that I invented the subject
`
`matter described above with regard to the play of Quad Poker earlier than 1 March 2001.
`
`26) Based upon my understanding of the law as explained to me by Patent
`
`Counsel, Mark A. Litman, these facts establish that neither the Kenny ‘468 Application
`nor the Kenny 60/277,018 establish a date for that reference that is early enough to
`provide prior art against my own invention date for the use of a dealer hand with more
`
`cards (e.g., 6-cards) than the number of cards in a player hand (5 cards) used to play a
`
`four-card poker game, as it does not establish an earlier or prior date.
