Case 1:24-cv-00053-TSK Document 23 Filed 08/02/24 Page 1 of 4 PageID #: 2790
`
`
`IN RE: AFLIBERCEPT PATENT LITIGATION
`
`
`IN THE UNITED STATES DISTRICT COURT
`FOR THE NORTHERN DISTRICT OF WEST VIRGINIA
`
`
`
`
`MDL No.: 1:24-md-3103-TSK
`
`
`
`
`THIS DOCUMENT RELATES TO
`ALL CASES
`
`
`
`REGENERON’S NOTICE OF JUDGMENTS FROM THE PATENT AND
`TRADEMARK OFFICE
`
`Plaintiff Regeneron Pharmaceuticals, Inc. respectfully submits the attached judgments
`
`
`
`issued by the United States Patent and Trademark Office in inter partes review proceedings
`
`concerning Regeneron’s Dosing Patents, U.S. Patent Nos. 11,253,572 and 10,888,601. The
`
`attached judgments order Regeneron to submit “notice and copy of this judgment in any
`
`proceeding or action involving” the ’601 or ’572 patents. Regeneron accordingly provides such
`
`notice and attaches the judgments here, for the sole reason that the ’601 and ’572 patents were
`
`included in Regeneron’s complaints against each Defendant in this proceeding. Regeneron
`
`expects to take appropriate action on the affected counts of each complaint in due course.
`
`The ’601 and ’572 patents are not related to U.S. Patent No. 11,084,865 (the subject of
`
`Regeneron’s motions for injunctive relief), are not the subject of any currently-briefed issue
`
`before the Court, and are not the subject of any appeal from this Court’s decisions. For clarity,
`
`the Court’s December 23, 2024, trial opinion in the Mylan/Biocon case (No. 22-cv-61) held
`
`certain claims of the ’572 and ’601 were invalid for obviousness. Regeneron has not sought
`
`appeal from this decision.
