Case 1:22-cv-00061-TSK-JPM Document 85 Filed 10/20/22 Page 1 of 3 PageID #: 2202
`
`IN THE UNITED STATES DISTRICT COURT
`FOR THE NORTHERN DISTRICT OF WEST VIRGINIA
`AT CLARKSBURG
`
`REGENERON PHARMACEUTICALS, INC.,
`
`Plaintiff,
`
`v.
`
`MYLAN PHARMACEUTICALS INC.,
`
`Defendant.
`
`Case No. 1:22-cv-00061-TSK
`
`MYLAN PHARMACEUTICAL INC.’S POST-HEARING SUPPLEMENT
`
`Mylan submits herewith an update to its proposed schedules which were previously
`
`submitted as an exhibit to the Parties’ Rule 26(f) Report (Dkt. No. 75-2). Regeneron’s October
`
`19, 2022 filing reveals (again) the unworkability of its unrealistic schedule, and illustrates the
`
`problems with Regeneron’s demands to indiscriminately apply 35 U.S.C. § 271(e)(4)(D) without
`
`considering limiting factors—especially when there are other available mechanisms for injunctive
`
`relief (as set forth in Mylan’s prior submissions (Dkt. Nos. 26, 75)).
`
`Respectfully submitted,
`
`STEPTOE & JOHNSON PLLC
