`PLEASE TAKE NOTICE THAT R.J. Reynolds Vapor Company is moving this Court in

`accordance with R.J. Reynolds Vapor Company’s Motion to for Entry of Judgment Under Rule
`
`54(b), seeking entry of final judgment under Fed. R. Civ. P. 54(b) as to Philip Morris Products
`
`S.A.’s asserted patents (Counterclaims I and III), because the Amended Judgment under Fed. R.
`
`Civ. P. 58 (Dkt. No. 1415) the Judgment under Fed. R. Civ. P. 58 (Dkt. No. 1457) have rendered
`
`final all claims pertaining to Philips Morris Products S.A.’s asserted patents. R.J. Reynolds Vapor
`
`Company’s Motion and Memorandum In Support of the Motion are being concurrently filed.
`
`Pursuant to Local Civil Rule 7(J) and Federal Rule of Civil Procedure 78(b), R.J. Reynolds
`
`Vapor Company waives oral argument and submits this motion on the record and R.J. Reynolds

`Vapor Company’s memorandum in support.
