`
`ORDER
`
`Counterclaim defendant, R.J. Reynolds Vapor Company(“Reynolds”) has filed a Motion
`
`to Redact Portions of the November4, 2022, Hearing Transcript (“Motion”) on the ground that
`
`the portions “reflect confidential business information.” The Court has reviewedall of the
`
`proposed redactions, and findsthat only the references to actual operating profits—on page 23,
`
`line 16, page 41, line 21, and page 44, line 4—qualify as “confidential business information.”
`
`All the other references deal with specific arguments the parties have over what a reasonable
`
`royalty would be or are what an expert opined, and the references to a product’s lack of
`
`profitability do not reveal a fact that could possibly put Reynolds at a competitive disadvantage.
