`JOINT STIPULATION FOR SUPPLEMENTAL DAMAGES

`Philip Morris Products S.A. (“Philip Morris”) and R.J. Reynolds Vapor Company
`
`(“Reynolds”), by and through their respective counsel, jointly stipulate and agree as follows:
`
`1.
`
`On June 15, 2022, the jury returned a verdict finding that (i) the Solo G2 infringed
`
`claims 1, 11, and 13 of the ’911 patent and (ii) the Alto infringed claims 1 and 4 of the ’265 patent.
`
`The jury awarded Philip Morris damages for past infringement through December 31, 2021 in the
`
`amount of $8,000,000 for the ’265 patent and $2,759,755 for the ’911 patent. Dkt. 1361.
`
`2.
`
`The Court entered judgment on June 15, 2022 pursuant to Rule 58 of the Federal
`
`Rules of Civil Procedure. Dkt. 1362.
`
`3.
`
`On June 28, 2022, pursuant to stipulation (Dkt. 1373 ¶ 8), the parties agreed to
`
`incorporate prejudgment interest in the amount of (1) $386,173 for the ’265 patent and
`
`(2) $249,986 for the ’911 patent.
`
`4.
`
`On July 27, 2022, pursuant to stipulation (Dkt. 1373 ¶ 5), Reynolds produced sales
`
`data showing net sales for the Solo G2 and Alto cartridges from January 1, 2022 to June 15, 2022.

`For the ’265 patent, Reynolds agrees to incorporate an additional $2,511,018 as part
`
`of the judgment to account for sales of Alto cartridges recorded between January 1, 2022 and June
`
`15, 2022.
`
`6.
`
`For the ’911 patent, Reynolds agrees to incorporate an additional $146,352 as part
`
`of the judgment to account for sales of the Solo G2 cartridges recorded between January 1, 2022
`
`and June 15, 2022.
`
`7.
`
`Reynolds agrees to incorporate the following additional amounts of prejudgment
`
`interest at the prime rate, compounded quarterly: (1) $8,851 for the ’265 patent and (2) $607 for
`
`the ’911 patent.
`
`8.
`
`Thus, the parties agree that the total amount of the judgment, including all
`
`prejudgment interest and supplemental damages, is (1) $10,906,042 for the ’265 patent, and
`
`(2) $3,156,700 for the ’911 patent.
`
`9.
`
`The foregoing is subject to any appeal of the judgment and the Parties’ stipulation
`
`for stay of execution on the judgment. Dkt. 1383.
