`UNITED STATES COURT OF APPEALS
`FOR THE SECOND CIRCUIT
`
`IN RE GOOGLE LLC,
`Petitioner
`
`
`
`
`
`On Appeal from the United States District Court
`for the Southern District of New York
`
`MOTION FOR ADMISSION TO PRACTICE PRO HAC VICE OF ASHLEY
`KELLER
`
`
`
`
`
`
`
`
`
`Case 23-910, Document 86, 09/27/2023, 3574784, Page3 of 7
`
`The undersigned counsel respectfully moves for leave to appear pro hac vice
`
`as counsel for Plaintiff-Respondents, the States of Texas, Idaho, Indiana,
`
`Mississippi, North Dakota, South Carolina, and South Dakota (“Plaintiff-
`
`Respondent States”) in the Petition for Writ of Mandamus by Petitioner-Defendant
`
`Google LLC of the Judicial Panel on Multidistrict Litigation’s June 5, 2023 Order.
`
`Undersigned counsel is an attorney from Keller Postman, LLC who is seeking
`
`to appear pro hac vice in this action pursuant to Local Rule 46.1(d)(3).
`
`Extraordinary circumstances justify admission for this particular proceeding. On
`
`September 26, the Court ordered that oral argument be heard the next week, October
`
`3. Other counsel involved in this action cannot appear for argument on that day.
`
`The undersigned counsel represented the Plaintiff-Respondent States in the
`
`underlying matter in the District Court for the Southern District of New York and
`
`before the Judicial Panel on Multidistrict Litigation, which issued the Order from
`
`which Petitioner-Defendant requested a writ of mandamus and is consequently able
`
`to prepare for argument in this Court on short notice. But, undersigned counsel is
`
`not yet admitted to the Court of Appeals for the Second Circuit and is filing an
`
`application to be admitted contemporaneously with this motion. Because that
`
`application may not be processed in time for the October 3 argument, the
`
`undersigned is filing this motion to appear pro hac vice, which may be processed
`
`more quickly.
