`STATEMENT OF THE ISSUES
`1. Whether an alien who is unemployed and has not attended school
`in several years is a bona fide student solely pursuing a course of
`study at an approved academic institution that will report termi-
`nation of attendance.
`2. Whether a district court may consider evidence that is inadmis-
`sible under the Federal Rules of Evidence and supplements the
`record in a review of an agency action when submitted in an
`amicus brief.
