`
`personal area network (PAN) using a wireless medium that is shared with a wireless local area
`
`network (WLAN), wherein WLAN devices communicate using protocols of the WLAN and

`
`REMARKS
`
`Claims 1-38 were pending in this application. Upon entry of this amendment,
`
`which amends claims 1, 3-5, 19-21, 29 and 34, and cancels no claims, claims 1-38 remain
`
`pending. Support for all amended claims can be found in the specification, and no new matter
`
`has been added.
`
`Reconsideration in view of the foregoing amendments and following remarks is
`
`respectfully requested.
`
`In the Office Action, the Examinerrejected claims 3-5 and 34-38 under 35 USC §112, 92,
`
`asserting indefiniteness as to the term “802.11x” which has been replaced by “802.11.”
`
`Applicant submits that the fact that a particular element may evolve over time does not render
`
`recitation of that element indefinite.
`
`It may change from time to time, but it is definite at any
`
`given time.
`
`In the Office Action, the Examineralso rejected all of the claims under 35 USC §103(a)
`
`asserting obviousness over two or more of U.S. Patent No. 7,039,358 to Shellhammer,
`
`etal.
`
`(hereinafter “Shellhammer’’), U.S. Patent Publication No. 2005/0286474 naming Van Zelst,et al.
`
`(hereinafter “Van Zelst”), U.S. Patent Publication No. 2006/0203841 naming Fischer(hereinafter
`
`“Fischer-M”), U.S. Patent Publication No. 2008/0291858 naming Kandala, et al. (hereinafter
`
`“Kandala’’), and/or U.S. Patent Publication No. 2008/01444938 naming Yeh (hereinafter “Yeh’’).
`
`Specifically, the Examiner rejected claims 1-5, 8, 10-24, 29-32 and 34 using Shellhammer and
`
`Van Zelst, claims 6-7, 9, 33, 35-36 and 37 using Shellhammer, Van Zelst and Fischer-M, claim
`
`25 using Shellhammer, Van Zelst and Kandala, and claims 26-28 using Shellhammer, Van Zelst
`
`and Yeh. Thus, each of the claims was rejected using Shellhammer and Van Zelst while some
`
`dependent claims were rejected over those references combined with others of the references.
`
`Applicant submits that since the combination of Shellhammer and Van Zelst does not
`
`disclose or suggest each element of a claim, at least as amended, and the remaining references do

`
`not make up for what Shellhammer and Van Zelst lacks, those claims are allowable over the
`
`cited references.
`
`For example, claim 1, as amended, further clarifies that a frame used for signaling a
`
`reservation is received by PAN devices wirelessly, thereby causing them to defer. Shellhammer
`
`does not show this because frames used for signaling in the 802.11 network are unrelated to the
`
`frames used in the Bluetooth network and the MU-BTM communication happens in a wired
`
`fashion.
`
`In Shellhammer, the reservation frames to the MU from the access point AP are
`
`unrelated to the start/stop frames from the MU to the BTMs. Van Zelst does not make up for
`
`what Shellhammerlacks.
`
`The remaining claims
`
`include additional elements that are also lacking in the
`
`Shellhammer, Van Zelst combination.
`
`Conclusion
`
`For the foregoing reasons, Applicants submit that all the claims are in condition for
`
`allowance. By responding in the foregoing remarks only to particular positions taken by the
`
`Examiner, Applicants do not acquiesce with other positions that have not been explicitly
`
`addressed. In addition, Applicants’ selecting some particular arguments for the patentability of a
`
`claim should not be understood as implying that no other reasons for the patentability of that
`
`claim exist.
`
`Finally, Applicants’ decision to amend or cancel any claim should not be
`
`understood as implying that Applicant agrees with any positions taken by the Examiner with
`
`respect to that claim or other claims.
