`For example, the iPhone 11 (running iOS 13)1 is a mobile communication terminal
`device configured for wireless and cellular communications.
`
`
`
`1 The accused Apple ’517 Products include any Apple iPhone, iPad, or Apple Watch presently imported into the United States,
`including, for example, any of the following products: the iPhone SE (A1662/A1723/A2275/A2296), the iPhone 11 (A2111), iPhone 11
`Pro (A2160), iPhone 11 Pro Max (A2161), iPhone XR (A1984), iPhone 8 Plus (A1864/A1897), iPhone 8 (A1863/A1905), iPhone 7
`Plus (A1661/A1784), iPhone 7 (A1660/A1778); iPad 6th Generation (A1954), iPad 7th Generation (A2198/2200), iPad mini 5th
`Generation (A2124/A2126), iPad Pro (11”) (A2013/A2068/A2230), iPad Pro (12.9”) (3rd / 4th generation)
`(A2014/A1895/A2069/A2232), iPad Air (3rd Generation) (A2123/A2153); and the Apple Watch Series 3 (A1860/A1861) and Apple
`Watch Series 5 (A2094/A2095). However, Maxell’s investigation into Apple’s infringement is ongoing, and Maxell believes that the
`infringement theories provided here apply with equal effect to other Apple products running materially similar software to iOS 13 and
`Watch OS 5. Although this chart contains user guide descriptions and screen shots from infringing products using a particular
`operating system (e.g., iOS13, iPadOS or WatchOS 5) as partial evidence of the Accused Apple ’517 Products’ infringement, these
`products nevertheless infringe the ’517 Patent’s claims when equipped with other operating systems which operate in materially the
`same way in view of the asserted claims of the ’517 Patent.

`Each of the Accused Apple ’517 Products has a first physical interface for making a

`
`For example, the iPhone 11 (and other Apple products running iOS 13 or materially
`similar software) uses a first cellular physical interface, such as an LTE, 5G E, CDMA,
`UMTS, or GSM physical interface to communicate with devices outside the iPhone 11,
`for example via a cellular network.

`
`Doctrine of Equivalents
`To the extent it is determined that this limitation is not literally embodied within the
`Accused Apple ’517 Products, this limitation is satisfied under the doctrine of
`equivalents because each device contains one or more components and/or software, or
`combination thereof, that perform substantially the same function in substantially the
`same way to obtain the same result. For example, to the extent any of the Accused Apple
`’517 Products does not have the claimed selection switching determination unit, on
`information and belief, each includes software, hardware, or a combination of the two
`that perform the equivalent function. The Cell ID of the selected or reselected cell is at
`the very least indicative of (and thus substantially the same as) the position of the mobile
`terminal. The mobility state and/or cell selection or reselection count is at the very least
`indicative of (and thus substantially the same as) the moving speed of the mobile
`terminal. Similarly, the available cell(s) or WiFi connections are indicative of (and thus
`substantially the same as) the available interfaces for selection. The selected or reselected

`

`cell or WiFi network is thus ultimately selected (and switched to) based on the
`communication availability, position, and moving speed of the mobile terminal.
`
`Each of the Accused Apple ’517 Products has a communication determination unit for
`determining whether or not each of the first and second physical interfaces is available
`for communication.
`
`As an example of a communication determination unit, the iPhone 11 contains one or
`more processors, a modem communication system and/or baseband processing module,
`and RF components to determine whether each of the first and second physical interfaces
`is available for communication. As an example, the iPhone 11 running iOS 13 includes
`software, hardware, or some combination of the two that determines whether the physical
`interfaces incorporated in the phone are available for communication. The existence of
`the claimed determination unit is evidenced by the phone’s ability to notify the user
`when the phone is connected to a first physical interface (such as LTE, GSM, or the like)
`and/or a second physical interface (e.g., WiFi).
`
`For example, the processor (e.g. CPU) in the Accused Apple ’517 Product is
`programmed to detect, or cause other components to detect, and notify the user (i) when
`the product is within range of a cellular network and can receive and transmit calls, or if
`there is no cellular service in the area, (ii) whether a 4G UMTS or LTE network is
`available, (iii) whether an LTE network is available, and/or (iv) whether 3G UMTS or
`EV-DO is available.
`
`In another example, the processor in the Accused Apple ’517 Product is programmed to
`detect and notify the user when WiFi calling is possible.
