`The Court held a discovery conference on November 17, 2021 and resolved the issues as
`
`follows:
`
`Issue
`Defendants’ motion to compel
`Plaintiff to collect and produce
`documents relating to Bob
`Weisse’s work with
`Symmorphix.
`
`Defendants’ motion to compel
`Plaintiff to collect and produce
`confidential files from the White
`v. Demaray litigation.
`
`Disposition
`Given (1) Plaintiff’s asserted conception and reduction
`to practice date of July 18, 2001 or earlier for the
`Demaray patents; and (2) that the Demaray patents
`require a reactor configuration having DC power to
`the target and RF bias to the substrate and narrow
`band rejection filter may be in an RF match
`component, Plaintiff is ordered to collect and produce
`any materials in its possession, custody or control
`involving Bob Weisse’s work with Symmorphix
`relating to DC power sources to a target, RF bias to a
`substrate, filters to protect a DC power source from
`damaging feedback from a RF bias power source, or
`other RF-related work (including, e.g., RF matches,
`any filters in RF matches, use of RF power in PVD
`chambers, filters blocking RF frequencies, lab
`notebooks of Symmorphix employees evidencing said
`work, and any documents reflecting RF-related
`deliverables from Bob Weisse), from Symmorphix’s
`inception through July 18, 2001.
`
`The Court DENIED Defendants’ motion.
`
