`PLAINTIFF MOBILEMEDIA IDEAS LLC’S REPORT REGARDING PATENTS
`
`On August 16, 2013, the Court entered an Order [402] denying Plaintiff MobileMedia
`
`Ideas LLC’s (“MobileMedia’s”) Motion to Sever or Stay [369] and allowing Defendants Research
`
`in Motion Limited and Research in Motion Corporation’s (collectively, “RIM’s”) motion to exceed
`
`the summary judgment page limit based on the number of asserted patents [401]. The Court also
`
`directed MobileMedia to inform the Court which patents MobileMedia intends to assert at trial,
`
`and stated that it would dismiss with prejudice any claims based on any patents not asserted or
`
`previously stayed. Accordingly, pursuant to the Court’s Order, MobileMedia states as follows:
`

`MobileMedia intends to assert the following patents at trial: U.S. Patent Nos. Re.
`
`39,231; 5,737,394; 6,070,068; 6,389,301; and 6,871,048.
`

`
`Application of the Court’s Order [402] would result in the dismissal with
`
`prejudice of MobileMedia’s claims for infringement from its Amended Complaint [164] with
`
`respect to U.S. Patent Nos. 6,446,080 (“the ’080 patent”), 7,349,012 (“the ’012 patent”), and
`
`5,490,170 (“the ’170 patent”), together with the dismissal without prejudice of the corresponding
`
`counterclaims of non-infringement, invalidity, and unenforceability asserted against the ’080,
`
`
`
`
