`JOINT MOTION TO EXTEND PAGE LIMITS

`In respect of the Court’s Order (D.I. 136) granting Defendants’ request to move for
`
`summary judgment of indefiniteness, and pursuant to the agreement of the parties filed with the
`
`court as a Joint Motion to Modify Docket Control Order (D.I. 118), the parties jointly move the
`
`Court for a ten-page extension of the page limits governing responsive and reply claim
`
`construction briefs so that the parties may address indefiniteness in their claim construction
`
`briefs, rather than separately-filed summary judgment briefs. The parties agree that these extra
`
`ten pages will be utilized exclusively to address indefiniteness issues.
`
`Specifically, the parties request that an additional ten pages be allowed for Defendants’
`
`Local Patent Rule 4-5(b) brief; an additional ten pages be allowed for Plaintiff’s Local Patent
`
`Rule 4-5(c) brief; and that Defendants be permitted to file a sur-reply limited to indefiniteness in
`
`accordance with the schedule set forth in (D.I. 118). The requested extension is sought in order
`
`to consolidate briefing on claim construction and indefiniteness issues, and the parties believe it
`
`will simplify and streamline presentation of the disputed issues to the Court.
