`JOINT CLAIM CONSTRUCTION AND PRE-HEARING STATEMENT

`Pursuant to P.R. 4-3 and the Court’s Docket Control Orders (as amended), Plaintiff
`
`Cellular Communications Equipment LLC (“CCE”), and Defendants AT&T Mobility LLC; LG
`
`Electronics, Inc.; LG Electronics USA, Inc.; Cellco Partnership d/b/a Verizon Wireless; Sprint
`
`Solutions, Inc.; Sprint Spectrum L.P.; Boost Mobile, LLC; T-Mobile USA, Inc.; T-Mobile US,
`
`Inc.; Sony Mobile Communications (USA) Inc.; and Kyocera Communications, Inc.
`
`(collectively, “Defendants”) submit this Joint Claim Construction and Pre-Hearing Statement
`
`with respect to U.S. Patent Nos. 8,385,966; 8,848,5561; and 8,868,060.
`

`
`The parties have not yet reached agreement regarding any terms for construction however
`
`the parties will continue to meet and confer in an effort to narrow the issues in advance of
`
`Markman briefing.
`
`
`1 U.S. Patent No. 8,848,556 has not been asserted against defendant Kyocera Communications,
`Inc. and, accordingly, Kyocera does not participate in this submission with respect to the ‘556
`patent.

`With respect to the terms that are in dispute, the chart attached as Exhibit A provides
`
`CCE’s proposed constructions, and the chart attached as Exhibit B provides Defendants’
`
`proposed constructions. Both Exhibit A and Exhibit B provide an identification of the intrinsic
`
`and extrinsic evidence upon which each party intends to rely to support its proposed
`
`constructions. Each party reserves the right to rely on any intrinsic or extrinsic evidence
`
`identified by the other party.
`

`The Court has set the Claim Construction Hearing for the patents at issue to begin at 9:00
`
`a.m. on December 17, 2015. CCE requests 60 minutes per side (2 hours total). Defendants
`
`request 90 minutes per side (3 hours total).
`
`Each side will submit its technology tutorial (to the extent it wishes to do so) to the Court
`
`by October 26, 2015. There will be no live technology tutorial prior to the Markman hearing
`
`except to the extent that the Court may have questions concerning the tutorials submitted by
`
`October 26th.

`At this time, neither CCE nor Defendants intends to call any live witnesses at the Claim
`
`Construction Hearing.
`
`CCE intends to rely on expert declaration(s) from Claude Royer to rebut Defendants’
`
`indefiniteness allegations and/or constructions. To the extent Defendants rely on an expert
`
`declaration in support of their indefiniteness allegations and/or constructions, CCE reserves the
`
`right to rely on one or more expert declarations in reply.

`Defendants intend to rely on Dr. Andrew C. Singer (CV attached as Exhibit C) to address
`
`Defendants’ indefiniteness positions and/or constructions, whether set forth in their Responsive
`
`Claim Construction Brief, their letter brief seeking leave to file a motion for summary judgment
`
`of indefiniteness, and/or their motion for summary judgment of indefiniteness.
`
`To the extent CCE relies on an expert declaration to rebut Defendants’ indefiniteness
`
`allegations, Defendants reserve the right to rely on one or more expert declarations to reply to
`
`CCE’s rebuttal declaration.
`

`At present, the parties are unaware of any additional issues that would require the
`
`scheduling of a pre-hearing conference prior to the Claim Construction Hearing.
`
`The parties would be willing to participate in a pre-hearing conference, if the Court
`
`deems one appropriate, to address issues such as whether the Court wishes to hear a live
`
`technology tutorial prior to the Markman hearing and whether the Court wishes to hear live
`
`expert testimony.
