`COUNTERCLAIM FOR INFRINGEMENT OF U.S. PATENT NO. 5,555,190

`Defendant and Counterclaim-Plaintiff, Micro Motion, Inc. (“Micro Motion”), and

`Plaintiff and Counterclaim-Defendant, Invensys Systems, Inc. (“Invensys”), by and through their
`
`undersigned counsel of record, submit this Joint Stipulation of Dismissal pursuant to Federal
`
`Rules of Civil Procedure 41(a)(1)(A)(ii) and 41(c).
`
`Whereas Micro Motion has agreed to dismiss with prejudice its counterclaim for
`
`infringement of U.S. Patent No. 5,555,190, but not to dismiss any of its other claims, affirmative
`
`defenses, or counterclaims in the case. Accordingly, counsel for Micro Motion and Invensys
`
`have met and conferred and hereby stipulate, subject to the Court’s approval, that:
`

`Micro Motion’s counterclaim against Invensys for infringement of U.S. Patent
`
`No. 5,555,190 (Count IV of Micro Motion’s Amended Answer, Affirmative Defenses, and
`
`Second Amended Counterclaims, (Dkt. No. 71 at 24-25)) shall be dismissed with prejudice; and
`
`2.
`
`Each party shall bear its own costs and attorneys’ fees with respect to the
`
`dismissed counterclaim.
